There are advantages that come from having travel insurance while away from home, but it’s also important to know about the limitations and exclusions attached to your travel coverage. Does TD Insurance Travel Insurance charge a deductible?

A deductible isn't charged for the TD Insurance Single-Trip Medical Plan, TD Insurance Multi-Trip Medical Plan, TD Insurance Multi-Trip All-Inclusive Plan and the TD Insurance Trip Cancellation & Interruption Plan.

What are pre-existing conditions?

A pre-existing condition is any medical condition that you have, that exists prior to the effective date of your travel insurance coverage. Having a pre-existing condition doesn’t disqualify you from getting travel insurance, but your pre-existing condition will have to be considered "stable" for a specified period of time before your effective date, to receive a coverage. It’s your responsibility as a policyholder to provide accurate medical information in your application. You should carefully review your policy to understand the pre-existing condition exclusion and what is and is not considered stable. If you have any questions, please contact your insurance provider.

How long do I have travel medical insurance coverage for?

Travel medical insurance coverage traditionally ends either on the insured person’s return date (as listed in the confirmation of coverage) or when they return to their province or territory of residence. However, if you’re experiencing an eligible medical emergency, your insurer may extend your coverage for a certain number of days. This can vary by insurer, so it is important to review your plan before you travel.

Can I extend my coverage while I’m away?

What are some travel exclusions?

Refer to your policy for full details of coverage and if you have any questions you should call our administrator, Global Excel. Contact our administrator immediately or as soon as reasonably possible in the event of an emergency. Failure to do so may result in reduced emergency medical benefits. If you need to cancel or interrupt your trip, contact our administrator no later than 24 hours following the covered cause for the TD Insurance Trip Cancellation & Interruption Plan or TD Insurance Multi-Trip All-Inclusive Plan.

Whatever travel insurance plan you may purchase, there are travel exclusions that will come into play. The complete list of what travel exclusions apply to your plan will appear in your policy, but here are some examples of the travel exclusions for these policies:

What travel limitations are there?

Limitations applicable to the TD Insurance Single-Trip Medical Plan, TD Insurance Multi-Trip Medical Plan and TD Insurance Multi-Trip All-Inclusive Plan:

It’s important to know that medical emergency benefits will only be paid for eligible medical emergency expenses. Costs that aren’t “eligible” will not be paid. These policies also top out at a maximum benefit of up to $5,000,000 for each insured person.

Limitations Applicable to the TD Insurance Trip Cancellation & Interruption Plan

Trip Cancellation benefits are available up to the amount of coverage you purchased to a maximum insurable amount of $25,000 per insured person, per covered trip.

Trip Interruption benefits are available for the unused portion of pre-paid travel arrangements, up to the amount of coverage you purchased prior to departure, to a maximum insurable amount of $25,000 per insured person, per covered trip.

TD faces class-action lawsuit over travel insurance and cancelled trips amid pandemic

Toronto-Dominion Bank is facing a class-action lawsuit over its refusal to pay travel insurance claims following trip cancellations triggered by the COVID-19 pandemic.

Lead plaintiff Kevin Lyons cancelled his family's flight to Italy along with their Mediterranean cruise in early March after the Canadian government advised against travel to the region, the proposed class action says.

TD turned down a $6,700 claim by Lyons, citing the travel credit available to him for the flights and cruise, according to the statement of claim filed in Ontario Superior Court.

Lawyer Sivan Tumarkin, whose firm represents Lyons, says future credit does not amount to cash reimbursement and that TD must pay the Toronto resident's claims under the terms of its own travel insurance policy.

"Nowhere does it say in the policy that if you're offered a credit or voucher that the insurance company is off the hook for reimbursing you that expense," he said.

Many Canadians are experiencing similar frustrations with travel insurers, since vouchers make a poor replacement for refunds given the uncertainty around travel and health over the next couple years, Tumarkin said.

"They're just angry. One lady, she said, `My elderly mother is not going to be able to travel. This was going to be the last trip.' For her it's principle. It's just not right,"' he said.

"How do we know that cruise line is going to be in business? It's so speculative now. These airlines, are they going to be in business?"

TD did not immediately respond to requests for comment.

Few individual claims against insurance companies have emerged since March due to the legal cost, Tumarkin said. But class-action claims, which have sprouted up in parts of the U.S., could mushroom north of the border as well.

Canadian airlines have also faced class-action lawsuits over their refusal to refund most passengers for services that were never rendered during the pandemic.

"I understand where they're coming from, whether I agree or not. But insurance companies have specifically insured against the risk of trip cancellation," Tumarkin said.

The lawsuit against TD Bank and TD Home and Auto Insurance must be approved by a judge if it is to go ahead.

TD Insurance Acted In 'Bad Faith' Not Refunding Travel During Pandemic: Lawsuit

Canadians who’ve been forced to cancel trips during the pandemic have launched a class-action lawsuit alleging TD Insurance acted in bad faith when it didn’t offer them full refunds.

The lawsuit is seeking $10 million in damages from the subsidiary of Toronto-Dominion Bank , claiming it took an “adversarial and hostile approach” and treated the plaintiffs with “suspicion and contempt” when they tried to get reimbursed thousands of dollars through their travel insurance, according to the statement of claim launched by Samfiru Tumarkin LLP last week.

“TD Bank has been unjustly enriching itself by collecting premiums and refusing to pay legitimate claims,” the statement said. None of the allegations have been proven in court.

TD declined to comment on the case as it is before the courts, but said “our trip cancellation coverage is consistent with the industry-wide position,” said spokesperson Elizabeth Goldenshtein.

As COVID-19 cases spread at a disturbing pace across the world last spring, Canadians called off travel plans and airlines cancelled flights at an unprecedented rate. Unlike their European or American counterparts, Canadian airlines have resisted giving cash refunds, instead for the most part opting for vouchers , despite customer pushback .

Some Canadians turned to their travel insurance companies for reimbursement but faced barriers.

“Insurance is supposed to give you peace of mind. Courts have held that insurance contracts are to protect you, to help you during a difficult situation,” lawyer Sivan Tumarkin told HuffPost Canada on behalf of the class-action members.

“But now, companies are trying to weasel away from that responsibility en masse. Not just TD, others too.”

The lawsuit was spurred by lead plaintiff Kevin Lyons, who along with his wife and children, had planned months in advance to go on a Mediterranean cruise departing near Rome on March 8, 2020.

But on March 2, Canada issued an advisory against all non-essential travel to northern Italy because of the rapidly spreading novel coronavirus. Lyon’s 16-year-old daughter is a Leukemia survivor and her doctor advised them not to go because of the health risk she’d face if she were to become infected with COVID-19, the lawsuit said.

Forced to cancel the trip, the Toronto family turned to their travel insurance with TD to be reimbursed for the non-refundable expenses totalling $6,673. Lyons also provided a letter from his daughter’s doctor, explaining why they had to cancel.

Initially, TD denied Lyons’ claim, incorrectly stating Global Affairs had not issued a travel advisory when Lyons had cancelled the trip, the lawsuit alleged.

“What did they expect these people to do? Go on the trip and get stranded?” Tumarkin said. “When the Lyons family was supposed to be on that trip there were cascading warnings .”

TD subsequently realized its mistake, but reimbursed only $79, claiming future credits would be available for the cruise and flights, the lawsuit said.

TD told HuffPost its trip cancellation coverage is available only if there are no other refund options.

“When a customer is provided with the option to receive 100 per cent credit and transfer their trip to a future date then they are not eligible for trip cancellation reimbursement in these instances,” the insurer said.

But in Lyons’ case, Expedia has yet to confirm any credits will be available for cancelled flights, and the cruise line’s credits are valid only to the end of 2021, said the lawsuit. Given Lysons’ daughter’s medical history, it’s unlikely the family would be comfortable travelling next year.

TD violated its own policy when it determined Lyons was not entitled to a full reimbursement because a credit or voucher may be an option, said the lawsuit. Its policy does not say the possibility of credit would disqualify a customer from getting their money back, Tumarkin said.

The class-action members have paid for insurance through premiums and credit card charges, and are entitled to have their claims reimbursed, said the lawsuit.

“It is only right that TD and other travel insurers honour their contractual obligations and pay legitimate claims when Canadians are experiencing unprecedented financial hardships,” Tumarkin said.

The lawsuit noted TD Bank reported insurance revenues in the second quarter of 2020 to be $1.13 billion, a 9 per cent increase compared to the same time the year before.

The class-action members are requesting TD be ordered to pay more than the claims to “deter insurers from making strategic, bad faith denials in the future,” the lawsuit said.

Since the lawsuit was filed a few days ago, Tumarkin said he’s received a huge amount of interest from people across the country, who’ve had experiences like Lyons with TD and other insurers. The lawsuit spans back to March 2018, but the pandemic has resulted in hundreds if not thousands of similar cases, he said.

Navigating the Lynx Air Shutdown: A Guide to Reclaiming Your Fare

On Feb. 22, Calgary-based budget airline Lynx Air announced its impending shutdown. Its operations ended on Feb. 26, leaving numerous Canadians scrambling to rebook their cancelled flights with alternative air carriers. 

Here’s what you need to know about securing a refund for unfulfilled Lynx airfare. 

Contact your card provider if you booked with a credit card 

Up until Feb. 26, Lynx Air had been urging passengers who booked airfare with a credit card to contact their card provider and request a charge reversal and payment refund . The Canadian Transportation Agency (CTA) seconds this recommendation.

However, as of Feb. 27, the airline’s messaging changed, stating on its website that passengers would receive emailed instructions on the refund process.

If you are asked to initiate a refund through your credit card issuer, you should be prepared to provide your financial institution with documentation of the airfare transaction and any communication from Lynx Air on the cancellation of your flight.

Do you have trip cancellation or interruption insurance?

Some forms of travel insurance — specifically, trip cancellation and interruption insurance — provide coverage in the event of a cancelled flight. If you have this type of insurance, either through your credit card or a third-party provider, review your policy to check what’s covered . Contact your insurance provider to report the cancelled flight as soon as possible, as many insurance claim processes are time-sensitive.

Note: you don’t need trip cancellation or interruption insurance to be eligible for a refund on your cancelled Lynx airfare. Canadian consumers can request a credit card chargeback from their provider any time paid services are not provided. 

If you booked with a travel agent, the province may reimburse you

Provincial governments in British Columbia, Quebec and Ontario offer protection for travellers with cancelled flights booked through a registered travel agent. Contact the provincial authorities to investigate next steps and learn more about what you’re entitled to receive:

  • Consumer Protection BC .
  • Office de la protection du consommateur .
  • Travel Industry Council of Ontario .

Did you use a debit card or Lynx Air travel voucher? File a complaint

Affected Lynx Air customers who used a debit card or Lynx Air travel voucher to book their flights may have a harder time getting a refund but aren’t without recourse. 

“Passengers who believe they are entitled to compensation, a refund or other remedies as a result of a cancellation of their flights can make a claim in writing to Lynx Air,” Jadrino Huot, spokesperson for the CTA, said in an email. “If dissatisfied with the response, or if no response is provided within 30 days, passengers can file a complaint.”

Complaints about Lynx Air can be filed on the CTA website by filling out an online form . Expect to provide information about your cancelled flight and proof that you have already attempted to contact Lynx Air in writing.   

Huot says that affected Lynx Air travellers should be aware that their ability to extract a refund from the defunct airline may be limited or delayed by the company’s creditor protection proceedings.

“All proceedings, including complaints filed with the CTA, against Lynx Air are stayed and suspended pending further order of the Court,” Huot said in an email. 

Lynx Air filed for creditor protection which provides companies with 30 days of protection from their creditors. As a result, the processing of existing complaints against the airline has been paused. New complaints can be filed, though they will not be processed while the stay is in place. As of Feb. 26, Lynx Air had 1,439 unresolved complaints with the CTA.

In a public statement posted on X, Canadian Transport Minister Pablo Rodriguez said, “I expect Lynx to fully refund you if your fare won’t be honoured. My office has been in touch with Lynx, we will continue to communicate with all parties, and we’ve convened calls with other airlines to see how they can help, to ensure that passengers are put first.”

While you wait for your CTA complaint to be addressed, document any correspondence you receive from Lynx Air. Securing a refund for your cancelled airfare may not be feasible under the extenuating circumstances of the air carrier’s shutdown. If a refund is possible, the process may be prolonged, so be prepared to wait weeks — even months — for a resolution.
