Visit visa extension in Dubai has become easier with the UAE government’s introduction of online channels and portals. These service channels allow you to conveniently manage entry permits, their validity, extension, and cancellation processes. Let’s first take a look at the visa extension process.

ELIGIBILITY

Before applying for a Dubai visa extension, you must check whether you fit the eligibility criteria. To apply for an extension, you must be a citizen of an eligible country and hold a valid passport with at least 6 months expiry date.

DOCUMENTS REQUIRED FOR VISA RENEWAL IN DUBAI

You will need the following documents to renew your tourist visa in Dubai.

  • A transcript of the applicant’s passport. Ensure the passport has a minimum validity of six months.
  • A passport-size photo with a white background.
  • Valid health insurance.
  • A ticket to and from your country.
  • Proof of a hotel/place of residence.

VISA RENEWAL/EXTENSION SERVICE CHANNELS

There are multiple ways to apply for a visit visa extension in Dubai. You can choose any of the methods listed below. They allow you to extend your visa for one or more trips for the same period.

  • Sign up or log in to the General Directorate of Residency and Foreigners Affairs Dubai ( GDRFA ) app.
  • Go to the dashboard and open dependent visa details.
  • Tap the “Renew Residence” icon.
  • Fill up the details.
  • Select delivery method.
  • Attach documents.
  • Submit the fee.
  • Wait for SMS/email confirmation.

  • Login/Register to the GDRFA website.
  • Click the “Services Guide”.
  • Go to the “Entry Permissions” option and click “Entry Permissions Sevices”.
  • Scroll down to the “Extension of entry permit” option and click it.
  • Select the most relevant service from the options listed on the site.
  • Click the “Start the Service” icon on the top-left.
  • Go to Amer’s website (amer247.com).
  • Click “UAE tourist visa” in the top-right corner. You will be redirected to a new tab featuring 14 types of tourist visas varying based on the number of days, validity and prices.
  • Select the most relevant one for you and click “Apply Now”.
  • Fill out the form by entering your credentials and travel details (number of passengers, passport copies and photos with white background).
  • Pay the fee.
  • Proceed to the completion of the process.
  • Go to the nearest Amer typing centre in Dubai .
  • Buy a queue ticket and wait.
  • Submit your application.
  • Wait for your request to proceed.

VISA PROCESSING TIME

Usually visa extension in Dubai takes 3 to 5 business days. However, the time may vary according to your visa type and other specific requirements.

Once you’re extended visa is processed, you can collect it via the visa application centre or a local post office as directed by the authorities.

HOW TO EXTEND TOURIST VISA IN DUBAI UPON ARRIVAL

Citizens of some countries can renew tourist visa in Dubai upon arrival for the same period. Here’s how to do it.

  • Log in to the GDRFAD smart service system through username or UAE Pass
  • Search for the visa renewal service
  • Fill in the application data
  • Pay the service fee

The following citizens can apply for a visit visa extension in Dubai upon arrival:

  • USA visa holder
  • US National
  • UK residence visa holder
  • Citizens with residence visa from European Union countries
  • Indian national with at least one special visa that is valid for six months or more

COST OF TOURIST VISA EXTENSION IN DUBAI

The general visit visa renewal UAE price is AED 600 with a 5% value-added tax. However, for those inside the country, the fee is AED 500.

The following additional fees are applicable if the sponsored person is inside the country.

Please note that the total visit visa renewal UAE price may vary depending on the circumstances surrounding the sponsored individual.

DUBAI TOURIST VISA EXTENSION FINE

Visa overstayers who don’t renew their tourist visa will have to pay a fine of AED 50 for each extra day they have overstayed. There used to be a 10-day grace period after which the fine was imposed. However, that is no longer the case, and the fine is imposed right after the day your visa has expired.

  • There are multiple types of tourist visas in Dubai , including five-year multiple entry tourist visa, Dubai visa on arrival and Dubai Visit Visa for GCC Nationals and Residents.
  • You can extend the validity period of UAE visa for additional 30 days, it can be done twice for every 30 days.
  • You can stay in the country for up to 120 days within the same year, this is the maximum duration allowed, and after this, you will have to extend your visa.
  • Check the expiry date of the first extension and apply for a second renewal before it expires.

EXEMPTION FROM A TOURIST VISA EXTENSION IN DUBAI

Certain tourists are not required to apply for a tourist Dubai visa extension. These include:

  • Residents in GCC countries
  • Visitors accompanied by GCC nationals
  • Those on special entry permits
  • Those on a “96-hour permit for special missions”

You can renew a tourist visa in other emirates of the UAE through the Federal Authority for Identity, Citizenship, Customs & Port Security (ICP/ICA). Here is how you can do it:

  • Visit the online portal of ICP/ICA.
  • Click on the “Services” tab.
  • Find “Individual Services” from the drop-down menu and click it.
  • Scroll down to the “Extension of a Multiple-Entry Tourist Visa” and click it.
  • Click the “Start Service” icon in the top-right corner.
  • Register via UAE Pass.
  • Apply to extend permit (Single/multiple entries).

Alternatively, you can visit ICP/ICA-approved typing centres to initiate the visa extension process in the UAE.

DO AIRLINES OFFER A VISIT VISA IN THE UAE?

You can apply for a visit visa through airlines like Etihad Airways, Emirates, Fly Dubai and Air Arabia. Each of them has different conditions. However, their basic condition is that you are flying with them.

CAN I APPLY FOR A RESIDENCE VISA IF I AM WORKING OUTSIDE THE UAE?

Yes, foreigners employed outside the UAE can apply for a virtual work visa . This one-year visa allows you to enter the country under self-sponsorship and work as per the terms and conditions of the issued visa.

To extend your visa, you need to use the “UAEICP” smart application and provide

  • your original entry permit
  • a recent photo.

Your passport must also have at least six months of validity left.

Cost of extending UAE Visit Visa

The fee for extending a visit visa for 30 days is Dh750, which includes various charges like issuance fee, application fee, smart services fee, and an insurance and authority fee.

To be eligible for this service, you should be a relative or friend of someone living in the UAE, and you need to provide proof of your relationship and reasons for your visit.

A UAE visa extension is the name of the procedure that allows you to stay longer in the UAE by extending your current visa or doing a status change to a new visa that has been extended through the in country visa procedure. The UAE visa extension procedure is mostly used by prepaid visa nationals as they need to apply for a visa to stay in the UAE, unlike GCC nationals (who dont need a visa) or on arrival visa nationals. It is better to apply a minimum of 5 days before your grace period is finishing which is the 95th or 35th day depending on the visa you initially applied for. You will be charged overstaying fines if your visa extension gets delayed.

If you need to stay longer in the UAE and want to extend your visa, you can go about it in any of the two ways mentioned below. You can choose either of the procedure based on your convenience and preference.

Procedure 1: Same Visa Extension

A same visa extension is when you extend the visa with which you entered UAE.

You can extend your visa twice with this procedure. You will get 30 days with the first extension and 20 days with the second extension.

What is the procedure for this type of extension?

Contact the same visa provider from whom you got your UAE visit visa issued and they will help you from there.

What is the total duration I can stay in UAE with this procedure?

You can stay for a total of 90 days or 150 days depending on whether your initial visa was a 30 day or 90 day visa. Here is a breakdown to ease your confusion:

Procedure 2: In country visa

What is an in country visa?

Also known as an inside country visa or no-exit visa, this procedure makes visa extension easy because the applicant doesn’t have to exit UAE for the new extension to get activated.

You can extend your visa as many times as you want with this procedure. There is no limit or restrictions

The fine for the first day of overstaying is 200 AED and 100 AED for every day overstayed from the second day. An additional service charge of 100 AED will be added while settling the fines during exit.

Musafir has 2 options : " Visa change by flight " to a " Visa change - Within the Country " (No exit required)

No. The customers do not need to exit to their home country. Musafir has 2 options :" Visa change via a flight " and a " Visa change - Within the Country " (no exit required).

There is no security deposit required to be paid at the airport for most nationalities. But certain nationalities may be required to deposit a refundable amount of AED 5,600 with Musafir.

Customers can avail this package through our retail offices, Whatsapp, online on Musafir.com or simply send the documents via email [email protected]. They then decide which of the two modes of Visa renewal they wish to opt for. For flights - We will then check the flight availability to Kuwait, Bahrain or Muscat and accordingly issue the Visa change ticket on Air Arabia or Fly Dubai. Carry this ticket and report at least 4-12 hours prior to the departure to the check-in counters at Sharjah airport/Dubai Airport and complete your immigration formalities. Fly out of the UAE and return to the Sharjah International Airport/Dubai International Airport on the same flight. Obtain the new visa from the travel consultant or exit via E-gate and re-enter the UAE. Inside the Country (No exit from UAE required) - Customer simply stays within UAE for his Visa to be mailed to him. No need to exit the country at all. Request to be sent atleast 4-5 working days prior to the last date.

All overstay fines have to be paid directly at the immigration counter.

The Visa approval is at sole discretion of the immigration authorities. In case of any rejection in providing a new visa, Musafir.com does not bear any responsibility for the application charges and no refund will be provided. In case of "Visa change by Flight" the visa applicant can stay at the airport for a maximum of 24-48 hours, post which they must arrange for a flight ticket directly to their home country from the respective airport.

ICP is the authority that handles visa extensions for tourists in Abu Dhabi, Sharjah, Ajman, Umm Al Quwain, Ras Al Khaimah and Fujairah. The UAE has simplified the process of extending visit visas for family members or friends who are visiting the country.

Visitors who have a visit visa valid for 30, 60, or 90 days can now apply for a 30-day extension on the UAEICP smart app, by paying a fee of Dh750.

The UAEICP app is an official service provided by the Federal Authority for Identity, Citizenship, Customs, and Port Security.

Documents and conditions for Visit Visa Extension in UAE

To apply for a 30-day extension of their visit visas, visitors must meet the following criteria:

  • They must be in the UAE at the time of application.
  • They must have a passport that is valid for at least six more months.
  • They must submit the original entry permit and a colored personal photo.
  • Provide any other additional document(s) as required.

  • You will need to fill out some details, attach documents, pay a fee, and wait for confirmation.
  • Parents must apply for their children below 18 years old.

  • Provide your passport copy with validity of at least six more months.

How Long you can stay after visa Extension

The GDRFA can extend your tourist visa for one or more times, but the total extension period cannot exceed 120 days in total. This applies to both single-entry and multiple-entry tourist visas.

How much it costs for visa extension

The fee depends on whether you are already in the country or not.

The basic fee for the visa extension is Dh600, plus five per cent VAT. This applies to both single-entry and multiple-entry tourist visas.

Not all visa applications can be completed on the day of the interview; please read the information below for more details .

Wait Time for Interview

The estimated wait time to receive a nonimmigrant visa interview appointment at a U.S. embassy or consulate and is based on workload and staffing and can vary from week to week. The information provided is an estimate and does not guarantee the availability of an appointment.

Wait Time for Interview Waiver

Wait times for applicants eligible for Interview Waiver are applicable only for locations where applicants schedule appointments to submit their passport and any required documents to a U.S. embassy or consulate. The wait time estimate does not account for the time required for a consular officer to adjudicate the application nor mailing time of passports or other documents. Refer to the website of the Embassy or Consulate Visa Section where you will apply to determine your eligibility for Interview Waiver and for instructions for submitting a nonimmigrant visa application. Note that applicants must be a national or resident of the country where they are applying to be eligible to apply via Interview Waiver.

Qualifications for an Expedited Interview Appointment

Consular sections overseas may be able to expedite your interview date if there is an urgent, unforeseen situation such as a funeral, medical emergency, or school start date. The process to request an expedited nonimmigrant visa interview varies by location. You should refer to the instructions on the website of the Embassy or Consulate Visa Section  where you will interview, or on their online appointment scheduling site. You will need to provide proof of the need for an earlier appointment.

In all cases : You must first submit the online visa application form (DS-160), pay the application fee, and schedule the first available interview appointment. Only at this point will a consular section consider your request for an expedited appointment.

Note: Travel for the purpose of attending weddings and graduation ceremonies, assisting pregnant relatives, participating in an annual business/academic/professional conference, or enjoying last-minute tourism does not qualify for expedited appointments. For such travel, please schedule a regular visa appointment well in advance.

These estimates do not include time required for administrative processing, which may affect some applications. When administrative processing is required, the timing will vary based on individual circumstances of each case.

There are only two possible outcomes for U.S. visa applications. The consular officer will either issue or refuse the visa. If a visa applicant has not established that he or she is eligible for a visa, the consular officer must refuse that application. However, some refused visa applications may require further administrative processing. When administrative processing is required, the consular officer will inform the applicant at the end of the interview. The duration of the administrative processing will vary based on the individual circumstances of each case. At the conclusion of the administrative processing period, the consular officer might conclude that an applicant is now qualified for the visa for which he or she applied. The officer may also conclude that the applicant remains ineligible for a visa. Visa applicants are reminded to apply early for their visas, well in advance of the anticipated travel date.

Important Notice:   Except in cases of emergency travel (i.e. serious illnesses, injuries, or deaths in your immediate family), before making inquiries about status of administrative processing, applicants should wait at least 180 days from the date of interview or submission of supplemental documents, whichever is later.

Every year, many expats come to the UAE, seeking greener pastures and a better life for their families and themselves. Unfortunately, these are also often the people that unscrupulous parties prey on with the aim of making a quick buck.

One among them is a visa fraud. Sometimes, when travellers fail to conduct sufficient research and rely on word of mouth, they can fall victim to a scam. Scammers across the globe attempt to collect applicant's information to exploit or charge them fees for fraudulent visas.

In order to stay safe and ensure that you are not being subject to fraud, keep these tips in mind:

1. Who is issuing your visa?

When getting your visa, make sure that you are getting it from an authorised entity to avoid getting scammed.

For maximum transparency, you can get a visa issued from travel agencies and hotels based in the UAE. Aside from this, UAE-based airlines (namely, Emirates, Etihad, Air Arabia and Fly Dubai) can also issue these visas.

2. Do you have the right kind of visa?

Make sure you take a look at the types of visas that can be issued, in order to ensure you don't get conned.

There are several types of visas that a visitor can apply for. They are:

a. Single entry tourist visa, valid for 30 days or 60 days

b. Multiple-entry tourist visa, valid for 30 days or 60 days

c. Multiple-entry long-term tourist visa, valid for five years

d. Transit visa, one for 48 hours and another for 96 hours

e. Visa on arrival, either for 30 days or 90 days contingent on nationality

f. Visa on arrival for Indians who have a visit visa issued by the USA, or a green card issued by the USA, or a residence visa issued by the UK or the EU

g. eVisa for residents of GCC countries (GCC citizens are eligible for visa-free entry)

These are the only types of visit visas one can apply for in order to enter the UAE. In case you're being promised another, you might be getting conned.

It's important to note that residence visas of any kind cannot be issued if you are outside the country. Applicants must be in the UAE in order to process this visa.

3. What kind of visa will you be working on?

Got a job offer from an organisation in the UAE? Ideally, they should bring you into the country on an employment visa.

However, keep in mind that while you can be called to the UAE on a visit visa, you will not be permitted to work on the same. So, if your employer is issuing a visit visa, you must ensure that you have a residence visa allowing you to be employed in the country before you begin work.

Here are four types of visas that allow an expat to work in the UAE .

Dubai: If you have heard of the UAE’s visa amnesty programme, but aren’t sure how you can go about regularising your visa status or helping someone do it, don’t worry.

The Federal Authority for Identity, Citizenship, Customs and Port Security (ICP) has provided a breakdown of the step amnesty seekers need to follow, depending on which visa you were on, and whether or not you wish to continue staying in the UAE.

So, here is an easy to follow breakdown of what you should do to benefit from the amnesty.

Procedures for different categories of violators

Residency violators:.

Individuals whose residence visa has expired and they do not have a valid work permit issued by the Ministry of Human Resources and Emiratisation (MOHRE).

Staying in the country – If you wish to continue working in the UAE, your new employer must apply for a new work permit either through MOHRE, or the relevant authority, depending on the establishment's affiliation. If you want to stay with your current employer, then you must renew your residency through ICP. Leaving the country – To depart the UAE, you must apply for an exit permit.

Individuals with expired work permits:

Individuals who have an expired residency and an expired work permit issued by MOHRE, as a private sector worker or a domestic worker. Staying with current employer – Your employer must renew your work permit. Changing employers – Your new employer must apply for a new work permit. Leaving the country – Apply for an exit permit.

Visit visa violators:

Individuals who have overstayed the duration specified by their visit visa.

Staying in the country – If you wish to work in the UAE, your new employer must apply for a new work permit, either through MOHRE or the relevant authority. Leaving the country – Apply for an exit permit.

Absconding workers:

Individuals whose residency has expired and who hold a valid work permit issued by MOHRE, either as a private sector worker or a domestic worker, with a pending complaint of work abandonment (absconding complaint) filed against them.

Staying with current employer – If the work permit has expired, the current employer can apply for a work permit renewal through MOHRE, without the need to cancel the absconding complaint. If the violating worker’s permit is still valid, the current employer must apply to cancel the absconding complaint. Changing employers – The new employer must apply for a new work permit through the Ministry or the relevant authority, depending on the establishment's affiliation. Leaving the country – Apply for an exit permit.

How do I apply for a visit visa?

Your visit visa has to be applied for by a sponsor, who is a person or organization who will be responsible for you while you are here, and will represent you to the authorities as and when required. For a visit visa, your sponsor could be:

  • A 30-Day Tourist Visa, which can be extended to 40 days
  • A 14-Day Service Visa, Or
  • A 30-Day Visit Visa which can be extended for other 30 days.
  • - Airlines and airlines handlers can apply on behalf of their crew members for a 96-hour transit visa
  • - Other organizations based in the United Arab Emirates may only apply for Visit Visas and Service Visas
  • - Individuals (Relatives Or Friends) already resident in the United Arab Emirates may, subject to guidelines, also apply on your behalf for a Visit Visa

Extension of Post Completion Optional Practical Training (OPT) and F-1 Status for Eligible Students under the H-1B Cap-Gap Regulations

ALERT: On Aug. 27, 2024, USCIS updated its  policy guidance regarding when students may be eligible for optional practical training (OPT) for Science, Technology, Engineering, and Mathematics (STEM) fields. The update also clarifies guidance concerning online study, school transfers, the grace period, and study abroad.

ALERT : Although F-1 nonimmigrant students with degrees in science, technology, engineering, or mathematics (STEM) may apply for a  24-month extension  of their post-completion OPT employment authorization, our policies regarding the cap-gap extension remain the same. An F-1 student who is the beneficiary of a cap-subject H-1B petition and request for change of status that is filed on time may have their F-1 status and any current employment authorization extended until the first day of the new fiscal year.

The “cap-gap” period starts when an F-1 student’s status and employment authorization expires and, unless terminated, ends on Oct. 1, the required start date of the H-1B cap-subject petition filed on their behalf if seeking cap-gap authorization.

Cap-gap occurs because an employer may not file, and USCIS may not accept, a cap subject H-1B petition submitted more than six months in advance of the date of actual need for the beneficiary’s services or training. As a result, the earliest date that an employer can file an H-1B cap-subject petition is April 1 for the following fiscal year, which starts Oct, 1. If USCIS approves the H-1B petition and the accompanying change of status request, the earliest date that the student may start the approved H-1B employment is Oct. 1, but the beneficiary’s OPT employment authorization may expire before the H-1B start date.

Current regulations allow certain students with a pending or approved cap-subject H-1B petition to remain in F-1 status during the cap-gap period. This is referred to as filling the "cap-gap," meaning the regulations provide a way of filling the "gap" between the end of F-1 status and the beginning of H-1B status that might otherwise occur were F-1 status not extended for qualifying students.

Cap-subject H-1B petitions that are timely filed for an eligible F-1 student that request a change of status to H-1B on Oct. 1 qualify for a cap-gap extension.

Timely filed means that the H-1B petition (indicating change of status rather than consular processing) was filed during the applicable H-1B filing period, which begins April 1 and while the student's authorized F-1 duration of status (D/S) admission was still in effect (including any period of time during the academic course of study, any authorized periods of post-completion Optional Practical Training (OPT), and the 60-day departure preparation period commonly known as the "grace period"). A cap-subject H-1B petition will not be considered to be properly filed unless it is based on a valid, selected registration for the same beneficiary and the appropriate fiscal year, unless the registration requirement is suspended.

Once the petitioner timely files a request to change status to H-1B on Oct. 1, the automatic cap-gap extension will begin. If the student’s H-1B petition is approved (or selected and approved if the registration requirement is suspended), the student’s cap-gap extension of status will continue through Sept. 30. The cap-gap extension of status will automatically terminate if the student’s H-1B petition is denied, withdrawn, revoked, rejected, or is not selected, or if the change of status request is denied or withdrawn even if the H-1B petition is approved for consular processing. The student will have the standard 60-day grace period from the date the extension of status terminated or their program end date, whichever is later, to depart the United States (however, the 60-day grace period does not apply to an F-1 student whose accompanying change of status request is denied or revoked due to a status violation, misrepresentation, or fraud).

Students are strongly encouraged to stay in close communication with their petitioning employer during the cap-gap extension period for status updates on the H-1B petition processing.

Please note: F-1 students who have entered the 60-day grace period are not authorized to work. If an H 1B cap-subject petition is properly filed for a student who has entered the 60-day grace period, the student will receive the automatic extension of his or her F-1 status, but will not be authorized to work since the student was not authorized to work at the time H-1B petition was filed.

F-1 students who do not qualify for a cap-gap extension and whose periods of authorized stay expire before Oct. 1 are required to leave the United States. They then need to apply for an H-1B visa at a consular post abroad, if applicable, and seek to be readmitted into the United States in H-1B status for the dates reflected on the approved H-1B petition.

Additionally, the cap-gap provision applies only to beneficiaries of cap-subject H-1B petitions, not to beneficiaries of  cap-exempt H-1B petitions .

The cap-gap extension of OPT is automatic for eligible students. A student does not file an application for the extension or receive a new Employment Authorization Document (EAD) to cover the additional time. The only proof of continued employment authorization currently available to an affected student is an updated Form I-20 showing an extension of OPT, issued to the student by their Designated School Official (DSO). This document serves as proof of continued employment authorization.

If a student chooses to obtain an updated Form I-20, they should provide their DSO with evidence of a timely-filed H-1B petition (indicating a request for change of status rather than for consular processing), such as a copy of the petition and a FedEx, UPS, or USPS Express/certified mail receipt. The student’s DSO will issue an updated Form I-20, showing an extension until June 1.

The student should return to their DSO with a copy of the petitioning employer’s Form I-797, Notice of Action, indicating that the petition was filed and accepted. The Form I-797 must have a valid receipt number. The student’s DSO will issue another updated Form I-20, showing an extension until Oct. 1. In such situations, the student can continue to work while the update to their Form I-20 is being processed. Because the cap-gap extension is automatic, the updated Form I-20 is not required for a student to continue working; it merely serves as proof of the extension of OPT employment authorization.

If an H-1B petition filed for an F-1 student with a cap-gap extension is denied, rejected, revoked, or withdrawn, the student will have the standard 60-day grace period (from the date of the notification of the denial, rejection, revocation, or withdrawal of the petition) to depart the United States.

The 60-day grace period does not apply to an F-1 student whose accompanying change of status request is denied due to a status violation, misrepresentation, or fraud. In such cases, the F-1 student is ineligible for cap-gap extension of status and the 60-day grace period. Similarly, the 60-day grace period and cap-gap extension of status does not apply to an F-1 student whose petition was revoked based on a finding of a status violation, fraud or misrepresentation discovered following approval. In both of these instances, students are required to immediately leave the United States.

An F-1 student may generally travel abroad and seek readmission to the United States in F-1 status during a cap-gap period if:

  • The student’s H-1B petition and request for change of status has been approved;
  • The student seeks readmission before their H-1B employment begins (normally at the beginning of the fiscal year on Oct. 1); and
  • The student is otherwise admissible.

However, if an F-1 student travels outside the United States while the H-1B petition and the change of status request remain pending the request for change of status will be considered abandoned.

Please note that even if an F-1 student meets all of the requirements listed above, a U.S. Customs and Border Protection (CBP) officer always makes the final determination on whether to admit an applicant for admission after inspection at a port-of-entry. F-1 students may refer to the DHS Study in the States page for a list of the documents needed to confirm eligibility for F-1 status.

F-1 students who receive science, technology, engineering, and mathematics (STEM) degrees included on the  STEM Designated Degree Program List (PDF) , are employed by employers enrolled in and maintain good standing with E-Verify, and who have received an initial grant of post-completion OPT employment authorization related to such a degree, may apply for a 24-month extension of such authorization. F-1 students may obtain additional information about STEM OPT extensions in the  USCIS Policy Manual , on our  Optional Practical Training Extension for STEM Students (STEM OPT) page, or the  STEM OPT Hub .

Students who are eligible for a cap-gap extension of post-completion OPT employment and F-1 status may apply for a STEM OPT extension during the cap-gap extension period.

However, students may not apply for a STEM OPT extension once the cap-gap extension period is terminated (if the H-1B petition is rejected, denied, revoked, or withdrawn) and the student has entered the 60-day grace period.

The law allows you to be unemployed during your OPT period for a limited number of days.

If the student’s OPT end date is shortened to Sept. 30 even though their H-1B employment would not begin until a later date, the student should contact their DSO. The DSO may request a data fix in the Student and Exchange Visitor Information System (SEVIS) by contacting the SEVIS helpdesk.

  • Laid off or terminated by the H-1B employer: If the student has been approved to change their status to an H-1B nonimmigrant but is laid off/terminated by the H-1B employer before the date they officially obtain H-1B status, the student can retrieve any unused OPT if they have an unexpired EAD issued for post-completion OPT. The student will remain in F-1 status and can continue their OPT using the unexpired EAD.

The student also needs to make sure that USCIS receives a withdrawal request from the petitioner before the H-1B change of status goes into effect. This will prevent USCIS from changing the student’s status to H-1B. Once the petition has been revoked or withdrawn, the student must provide their DSO with a copy of the USCIS acknowledgement of withdrawal (the notice of revocation). The DSO may then contact the SEVIS helpdesk to request a data fix in SEVIS to prevent the student from being terminated in SEVIS.

If USCIS does not receive the withdrawal request before the date that the student is supposed to change status to an H-1B nonimmigrant, then the student will need to stop working, file Form I-539, Application to Extend/Change Nonimmigrant Status, to request F-1 status, and wait until the change of status request is approved before resuming OPT employment.

The F-1 student can continue working with their approved EAD while the data fix in SEVIS is pending if:

  • The (former) H-1B employer withdrew the H-1B petition prior to Oct. 1
  • The student finds employment appropriate to their OPT;
  • The period of OPT is unexpired (which would indicate that the student was not actually utilizing “cap-gap” since they otherwise had valid OPT authorization); and
  • The DSO has requested a data fix in SEVIS.
  • The student has not otherwise violated their F-1 status.
  • Maintaining valid F-1 status: If the employer withdraws the H-1B petition before the date that the student officially changes to H-1B status, the student generally will remain in F-1 status while the data fix is pending. The student would have the standard 60-day grace period to depart the United States unless the H-1B petition was revoked because of fraud or violation of status.

If the employer withdraws the H-1B petition approval after the date that the student officially changes to H-1B status, the student’s status will have been changed from F-1 to H-1B. The student will no longer be in valid F-1 status and would need to file a Form I-539 if seeking to change back to F-1 status.
