Luxury handbag designer sentenced to prison after smuggling bags made out of protected species into U.S.

A Colombian handbag designer has been sentenced to 18 months in prison after federal prosecutors said she illegally smuggled handbags made from caiman and python skin — both protected species — to New York. 

Nancy Teresa Gonzalez de Barberi, the founder of luxury handbag company Gzuniga Ltd., had been indicted in April 2022 on a charge of conspiracy and two counts of smuggling into the U.S. for illegally importing the bags from February 2016 to April 2019. 

Gonzalez and her company had pleaded guilty to the federal charges in November 2023. 

The Department of Justice said in a news release that Gonzalez made bags of caiman and python skin — both of which are protected by the Convention on International Trade in Endangered Species of Wild Fauna and Flora, an international agreement to protect wildlife signed by both the U.S. and Colombia.

Under the Endangered Species Act, the trade of such species isn't fully banned, but requires a permit issued by the host country to be cleared by U.S. officials upon importation. 

Gonzalez, her company, and co-conspirators Mauricio Giraldo and John Camilo Aguilar Jaramillo were accused of bringing hundreds of designer purses, handbags and totes to the U.S. by “enlisting friends, relatives, and even employees of Gonzalez’s manufacturing company in Colombia to wear the designer handbags or put them in their luggage while traveling on passenger airlines,” prosecutors said.

Once in the U.S., the bags were then delivered or shipped to the Gzuniga showroom in New York “to be displayed or sold,” they added.

Gonzalez, Giraldo and Aguilar Jaramillo are all Colombian citizens who were extradited to the U.S. on the same charges.

Gonzalez was sentenced Monday to prison time with credit for time served, three years of supervised release and to pay a special assessment.

Her company was ordered to forfeit all handbags, banned for three years from any activities involving commercial trade in wildlife and sentenced to serve three years of probation. 

Also on Monday, Giraldo was sentenced to time served, a year of supervised release and to pay a special assessment.

The other co-conspirator, Aguilar Jaramillo, is scheduled to be sentenced on June 27.

NBC News has reached out to attorneys for Giraldo for comment.

Sam Rabin, an attorney for Gonzalez, said Tuesday she was “the victim of selective prosecution.”

“While most major purse designers rush samples to fashion shows, sometimes without the proper paperwork, only she was chosen to be prosecuted by the Department of Justice,” Rabin said. “She employed hundreds of minority women who helped produced the handbags that she alone designed.”

He said the judge recognized her case “should had been handled administratively instead of by arrest and prosecution,” which is why her sentence amounts to a month in jail due to time served in Colombia awaiting extradition. 

“She will not appeal her sentence. She wants to put this unfortunate chapter behind her and move on with her life,” Rabin said. 

“This investigation uncovered a multi-year scheme that involved paid couriers smuggling undeclared handbags made of CITES-protected reptile skins into the U.S. to be sold for thousands of dollars," Edward Grace, the assistant director of the U.S. Fish and Wildlife Service’s Office of Law Enforcement, said in a statement.

"The Service will continue to seek justice for protected species exploited for profit, and we will hold accountable those who seek to circumvent international controls meant to regulate their sustainable trade," he added.

The case was investigated by the U.S. Fish and Wildlife Service Office (USFWS) of Law Enforcement in Valley Stream, New York, with assistance of the Miami Resident Agent in Charge Office of USFWS. The case was prosecuted by the U.S. Attorney's Office of the Southern District of Florida and the Justice Department’s Environmental Crimes Section.

Joe Biden grants clemency to 16 individuals, including three in Tennessee

President Joe Biden announced on Wednesday that he would be granting clemency to 16 individuals who were convicted of non-violent drug offenses. Three of those individuals are from Tennessee — Daequon Charles Davis from Johnson City, Xavier Martez Parnell from Clarksville and Leshay Nicole Rhoton from Bristol.

Davis, Parnell and Rhonton were granted a commutation of sentence, meaning their sentences will be reduced.

Davis was originally sentenced to 262 months of imprisonment and 10 years of supervised release. The sentence has now been commuted to a term of 120 months, leaving intact and in effect the 10-year term of supervised release with all its conditions and all other components of the sentence.

Parnell was convicted of conspiracy to distribute and possess with intent to distribute controlled substances, including 500 grams or more of cocaine and 280 grams or more of cocaine base in September of 2012. Parnell was originally sentenced to 300 months of imprisonment and 10 years of supervised release. The sentence has now been commuted to a term of 210 months, leaving intact and in effect the 10-year term of supervised release with all its conditions and all other components of the sentence.

Rhoton was convicted of conspiracy to possess with the intent to distribute 280 grams or more of cocaine base and 5 kilograms or more of cocaine in September of 2013. Rhoton was originally sentenced to 240 months of imprisonment and 10 years of supervised release. The sentence has now been commuted to a term of 150 months, leaving intact and in effect the 10-year term of supervised release with all its conditions and all other components of the sentence.

Former Colorado paramedic Jeremy Cooper sentenced to probation, work release after conviction in death of Elijah McClain

Former Colorado paramedic Jeremy Cooper was sentenced to four years probation, 14 months work release and 100 hours of community service on Friday afternoon. Cooper is one of the two paramedics who were found guilty of criminally negligent homicide in the  death of Elijah McClain .

Adams County District Judge Mark Warner stayed Cooper's sentence until June 7, which he said will give Cooper time to "make arrangements to continue his employment."

Former Aurora Fire Rescue paramedic Peter Cichuniec was sentenced last month to 5 years in prison  last month and 3 years of probation by the same judge, Adams County District Judge Mark Warner. He said the sentence and the example it might send are tied to public safety, but also said he does not believe Cichuniec is a risk to the public.

McClain was walking home in August 2019 when the 23-year-old Black man was confronted by police officers who forcibly restrained him and then the Aurora Fire Rescue paramedics --  Jeremy Cooper and Cichuniec  -- injected him with ketamine.

He went into cardiac arrest in an ambulance a few minutes later and died three days after that.

Cooper speaks directly to Elijah before sentencing

Cooper spoke in court before his sentencing, after several others testified about his character on his behalf about how he was a devoted husband, a devoted firefighter and a paramedic for more than 20 years. 

"What I would like to do now is just talk to Elijah. Elijah, I am a man of faith, I know you are here among us and I know you can hear me. I wish I wasn't standing here, talking up to you, because that would mean that you are here. There's so much I want to say to you, first I want you to know how sorry I am that I couldn't save you. I want you to know how sorry I am that I didn't get to hear your last words. I want you to know that I would give anything to have a different outcome," said Cooper. "I am so sorry, collectively, that we all failed you."

Elijah's mother gives statement in court

During Cooper's statement, Sheneen McClain, Elijah's mother, walked out of the courtroom for a time until she returned to speak at the podium before the judge handed down Cooper's sentence. 

"Jeremy Cooper did what he thought was best. He did nothing. Jeremy Cooper did not check for my son's pulse. Jeremy Cooper did not conduct a thorough examination to see if my son was breathing normally. Jeremy Cooper did not interact with my son or ask my son how he was doing under the weight of a monster. Jeremy Cooper was there for more than several minutes before my son took his last words. Jeremy Cooper heard my son talking and was there for my son's last words. But Jeremy Cooper just stood there like a drug dealer waiting for his sale," said Sheneen McClain. "Nothing Jeremy Cooper can say can bring back my son or remove my son's blood from his hands."

Cooper's wife makes statement before sentencing

"On the tragic night of Elijah McClain's death, knowing Jeremy and knowing his heart, and his integrity, I know he was using his calm, even-keeled demeanor to try to help save Elijah. There was just so much that he didn't have control over," said Cooper's wife Tarrah Cooper before the judge handed down the sentence. "The loss of life is a tragedy, there is no disputing that and Jeremy will carry the loss of Elijah with him forever just as he does all the patients that he was not able to save. Jeremy has relived that eight minutes many times a day for the last nearly five years."

History of court proceedings in death of Elijah McClain 

Cooper and Cichuniec were both convicted  in December 2023.

In addition to criminally negligent homicide, Cichuniec was also found guilty of second-degree assault-unlawful administration of drugs, a conviction that typically carries a 5-to-16-year prison sentence. The judge handed down the minimum five-year sentence. 

Three officers from the Aurora Police Department have been tried in connection to McClain's death. Last fall, two of the officers  were acquitted  in Elijah's death and a third was found guilty. 

Elijah McClain Officer Sentenced

A jury found  Randy Roedema guilty of criminally negligent homicide  and third-degree assault, while Jason Rosenblatt was found not guilty of manslaughter and assault in October 2023. A  jury also found Nathan Woodyard not guilty  of manslaughter and criminally negligent homicide in the 23-year-old's death.

In January, Roedema  was sentenced  to 14 months in jail along with four years of probation. He has  filed an appeal  and is asking the court to review nine different aspects of the case.

The City of Aurora agreed in 2021 to pay $15 million to settle a civil lawsuit brought by McClain's parents.
