Gun on their Frantic tour.

As always, these guys are outstanding on stage. They did a great mix of numbers from the past which we all

Love to sing along to, and also some new songs from their new album Frantic. Their music just gets better. Dante told us he felt the band was experiencing a re birth and how right that it... We, the fans feel it too and it's simply glorious! I wish them all the best for the future but there's no doubt it's going to be great for them. This is a band that truly appreciate their fans, hold no airs and graces, and holdo. To their values. Brilliant! Absolutely brilliant.

Simply sublime!!! Last time i saw them was 1992 supporting def leopard so there's been some changes since then, obviously mark leaving and Dante taking over on vocals, oh my days he smashes it perfectly!!! The new album songs they played were so exciting to hear too, but for me personally songs from "taking on the world" and "gallus" were pure class. A fantastic band who had time for every single fan at the end, one of the best nights and gigs I've been to. They are 30yrs old next year and better than ever!!!!

What a fantastic night. Having last seen Gun (properly, not sure the CD playback little acoustic do really counts) at Birmingham NEC it was so nice to be in a small vnue. Dante looked like he was having the time of his life, not sure I have seen a front man smile so much at a gig ever. The mix of old and new songs went down really well, especially a the album had only been out 24 hours. Can't wait to see them at Camden Rocks!

After not seeing GUN for almost 20yrs I had low expectations.

Well more fool me as GUN rocked..big guitars, violent drumming and great crowd interaction it was a belter of a gig!

Old favourites and a few new tunes kept the crowd buzzing.

Granted, the audience was in the 40+ bracket but those missing certainly missed a trick.

Keep an eye out for future gigs... You won't regret it

Once again another great gig by gun really enjoyed it it's a shame more people weren't there to see them it was a good venue for them to play in if u can go and see them because you won't be disappointed

Machine Gun Kelly Tour

Machine Gun Kelly is taking his chart-topping album Tickets To My Downfall on the road this upcoming fall on a 27-date tour. The Tickets To My Downfall Tour will kick off in Minneapolis on September 9 and run through December 18 when it wraps up in the rapper-turned punk rocker’s hometown Cleveland, Ohio. Pre-sale for the tour begins April 27 with the general sale beginning on April 30.

Additional tour dates will be announced in the future. Machine Gun Kelly will be bringing rising alternative artists carolesdaughter, jxdn and KennyHoopla along on tour with him.

The Tickets To My Downfall tour marks the first time the musician will be performing his platinum-selling singles “Bloody Valentine,” “My Ex’s Best Friend,” and more in front of a live audience, as opposed to the television specials and awards shows he’s had to make do with for the past year.

Tickets To My Downfall  was released in October and debuted at No. 1 on the Billboard 200. The album was also adapted into a high school-set movie musical back in January and featured appearances by Trippie Redd and Iann Dior.

The singer and actor also shared his career ambitions in an recent interview with KROQ. “I want to break the mold of everything I just did and piss people off all over again. When I say, ‘Break the mold and piss people off all over again,’ I just mean make them think again; make them have a moment of, ‘This artist is so polarizing [that] I have to tune in.’”

Video shows upstate NY officer fatally shooting 13-year-old, police say he had replica gun

The shooting happened just after 10 p.m. friday in utica, by the associated press • published june 30, 2024 • updated on june 30, 2024 at 11:29 am.

Video released late Saturday shows an officer in upstate New York fatally shooting a 13-year-old boy who had been tackled to the ground after he ran from police and pointed a replica handgun at them.

The teen was killed a little after 10 p.m. Friday in Utica after officers in the city about 240 miles northwest of Manhattan stopped two youths in connection with an armed robbery investigation, police said.

The youths, both 13, matched the descriptions of the robbery suspects and were in the same area at around the same time the day after, police said. One was also walking in the road, a violation of state traffic law.

The body camera video released by police captures an officer saying he needs to pat them down to ensure they don't have any weapons in their possession. Immediately one of the two, identified by police as as Nyah Mway, runs away.

Authorities froze frames of the video where a running Nyah Mway appears to point the gun at the pursuing officers. Police also edited the video to insert a red circle around the weapon to show it to viewers.

The officers believed it was a handgun, police said, but it was later determined to be a replica of a Glock 17 Gen 5 handgun with a detachable magazine.

"During a ground struggle" with the teen, one of the officers fired a single shot that struck the boy in the chest, Utica Police Chief Mark Williams said.

Brawl in Connecticut raised concerns as authorities continue investigation

The teen was given "immediate" first aid by the officers and taken to Wynn Hospital, where he died, the chief said.

The replica gun carried by the teen "is in all aspects a realistic appearing firearm with GLOCK markings, signatures, detachable magazine, and serial numbers," Lt. Michael Curley, a police spokesperson, said via email. "However ultimately it fires only pellets or BB's."

A bystander video posted to Facebook shows one of the officers chasing after Nyah Mway and tackling him to the ground. It also shows the officer punching the teen as two other officers arrive. A gunshot rings out as the teen is on the ground and the officers quickly stand up.

The officer who fired his gun was identified as Patrick Husnay, a six-year veteran of the agency. Husnay and Officers Bryce Patterson and Andrew Citriniti were placed on administrative leave with pay.

The police body camera video shows a chaotic scene.

Nyah Mway points the replica handgun at the officers while he runs from them. The officers scream "gun!" to each other as they run. Patterson then tackles and punches Nyah Mway, and as the two are wrestling on the ground, Husnay opens fire.

Officers initially thought Nyah Mway may have shot himself, and Patterson says, "I don't know if he shot me." It is not clear whether he is referring to Nyah Mway or his fellow officer. Patterson was not struck.

Bystanders scream at the police throughout the recordings, and at one point an officer yells back: "We're trying to save him right now!"

The other youth was detained in the back of a police vehicle and was not involved in the shooting.

During his "public safety statement," a brief interview typically done in the aftermath of a police shooting to ensure there is no additional threat, Husnay said he fired one round "straight towards the ground." He did not know whether Nyah Mway had fired at the officers but said he thought the weapon was a 22-caliber handgun.

The police department released the body camera videos following a public outcry as the shooting roiled Utica, a city with a population of 65,000. It is home to more than 4,200 people from Myanmar, according to The Center, a nonprofit that helps to resettle the refugees.

Nyah Mway, who local media reports said was an 8th grader at Donovan Middle School, was identified as a refugee born in Myanmar and a member of the Karen ethnic minority.

Karens are an ethnic minority among the groups warring with the military rulers of Myanmar, the Southeast Asian country formerly known as Burma. The army ousted the elected government of Aung San Suu Kyi in 2021 and suppressed widespread nonviolent protests that sought a return to democratic rule.

A tense news conference Saturday ended early as Williams, the city's mayor and an interpreter struggled to speak over repeated audience outbursts. Members of the community, including the youth's family, were in attendance.

The police department is conducting an internal investigation to see whether officers followed policies and training. The state attorney general will open its own case to determine if the shooting was justified.

"I want to offer my heartfelt condolences to the family of the deceased party during this difficult time," Williams said. "This is a tragic and traumatic incident for all involved."

New concealed carry law will allow 18-year-olds to have guns without permit starting Fourth of July

SHREVEPORT, La. (KSLA) - Louisiana has now become the 28th state to allow adults to conceal a weapon without a permit.

KSLA News 12′s Miracle Garett talked to police and went to a gun range to see how this new law will impact gun owners.

Governor Landry signed Senate Bill 1 back in March. The law allows citizens over 18, who are not convicted of a felony, to possess a firearm. It will go into effect on July 4. But what danger can this pose for other citizens?

“Shreveport Police Department receives training annually. We go through a re-trainer program, which our officers are instructed and taught the newest laws and the newest techniques of law enforcement,” Cpl. Chris Bordelon said.

Louisiana had the country’s second highest rate of gun related deaths in 2021. Will the state see a decrease in gun violence?

“Well that’s something we’re going to have to wait and see; we don’t really know. There’s a lot of people that made claims on both sides. As law enforcement officers, we don’t get involved in the political disputes. Our job is to enforce the laws put before us and that’s exactly what we’re gonna do.”

Senate Bill 1 has a few restrictions though.

“There are restrictions in place that you can’t go into a 1000-foot buffer around school zones. No firearm zones. You can’t go into any establishment that sells alcohol. If you travel, you still need a permit for reciprocity.”

Even though training courses are not required under the soon-to-be law, they are still highly recommended.

“Being a responsible gun owner means you still have the responsibility to be trained,” owner of Red River Range Brad Simon said.

The gun range has several courses available for those willing to learn.

“We offer, whether it be, the conceal carry course or we also offer our conceal carry fundamentals,” Simon said.

Review: smaller solo sound still earns a large reception for big thief's adrianne lenker.

As dance beats pumped loudly outside from a Pride block party along Hennepin Avenue, Adrianne Lenker quietly created a whole other kind of thump-thump-thumping inside the State Theatre on Sunday night.

The singer for the increasingly influential folk-rock band Big Thief had her audience members' hearts jumping and pounding for the second of two sold-out solo-acoustic gigs in her former home state.

Her 95-minute performance was often hushed, rarely got above midtempo urgency and always sounded tender and fragile. By show's end, though, it still felt like a jubilant celebration and emotional thrill ride.

"This place is definitely in me in a deep way," Lenker, 32, said while acknowledging her family in attendance and their roots in Minnesota (mainly around Nisswa). She also praised the Twin Cities for putting on such widespread Pride festivities.

This backdrop may have added an extra tinge of sentiment on her end, but Lenker always seems to pour her heart out for audiences whether she's with her experimental, Grammy-winning band or playing all by herself.

"I wish I was better at being alone," she sang in her unmistakably wavering but strong voice in the direction-pondering solo-LP oldie "Steamboat," lyrics that sounded ironic.

Lenker actually has gotten better at solo shows. Her finger-picking guitar work sounded much fuller and more evocative Sunday — and her voice way more pronounced — than at her last solo gigs at the Cedar Cultural Center in 2021, when Big Thief was just beginning to break big. Conversely, she lost none of the intimate vibe moving up to a much larger venue (a size Big Thief has now outgrown).

Big Thief tunes were sprinkled in here and there throughout Sunday's set list, starting with the night's second song, "Simulation Swarm." Other selections from the band's catalog included "Spud Infinity" (joyously performed with her brother Noah Lenker on jaw harp), "Forgotten Eyes" (given a more upbeat, twangy spin) and "Dragon New Warm Mountain I Believe in You" (saved for a moving encore finale).

The crowd seemed as familiar and smitten with songs off her lesser-known solo LPs — a sign of the cultish devotion developing around Lenker as a songwriter.

After some of the 2,200 fans quietly murmured lyrics in the night's opening song, "Not a Lot, Just Forever," she urged them to go all-in singing along to another of her solo favorites, "Anything." And just like that, the show took on a strong campfire-sing-along vibe, which carried through to "Sadness as a Gift," "Steamboat" and "Indiana," too.

The mood turned heavy here and there. In "Donut Seam," Lenker sang about getting in a good swim before the world's water dries up. She introduced another darkly poetic new song, "Fangs Lungs Ankles," as being sold online to benefit the Palestine Children's Relief Fund.

Those moments were balanced out by lighter highlights such as "Born for Loving You," which she admitted was written about the night's opening act, Texan Americana strummer Staci Foster , who she is dating.

With the sort of clumsy giddiness of one of John Prine's more romantic tunes, Lenker sang, "From my first steps to my first words / To waddling around looking at birds / To the teenage nightmare, mine and yours / Thank God we made it through / 'Cause I was born for loving you."

And there went the hearts.

Chris Riemenschneider has been covering the Twin Cities music scene since 2001, long enough for Prince to shout him out during "Play That Funky Music (White Boy)." The St. Paul native authored the book "First Avenue: Minnesota's Mainroom" and previously worked as a music critic at the Austin American-Statesman in Texas.

Hidden fees, gun taxes, date-rape testing kits: New California laws that take effect in July

A white building with a large dome sits between two large trees

California’s legislators pass hundreds of new laws each year, most of which take effect in January. But a handful kick in on July 1, the start of the state’s fiscal year.

Signed by Gov. Gavin Newsom last year, the wide-ranging new laws include sweeping protections for California consumers against hidden “junk” fees that add unexpected costs to everything from concert tickets to food delivery . The laws also tackle issues related to housing affordability, the difficulty of fixing your own iPhone and other electronic devices, and screening measures to detect date-rape drugs in alcoholic drinks at bars and nightclubs.

As in years past, the list mostly reflects the politics and interests of the Democrats who hold a supermajority of seats in the state Assembly and Senate.

Here’s a look at several of the new laws that will take effect Monday.

No more hidden fees

Two new laws will require that businesses including hotels, food delivery apps, airlines and concert venues include all mandatory fees and surcharges in their advertised prices.

The wide-reaching transparency law, Senate Bill 478 , will apply to many industries. The charges that must be disclosed upfront to customers include resort fees at hotels, cleaning fees for lodging rental platforms like Airbnb and Vrbo, venue fees for concerts and sporting events, and surcharges for driver benefits and deliveries on apps like DoorDash and Uber Eats.

The bill was sponsored by Sens. Bill Dodd (D-Napa) and Nancy Skinner (D-Berkeley) and backed by Atty. Gen. Rob Bonta.

California is making restaurants tell the truth about prices. Will it give you sticker shock?

In long-awaited guidelines for SB 478, the state’s ban on ‘drip pricing,’ Atty. Gen. Rob Bonta makes it clear that restaurants will have to include surcharges and fees in the prices on their menus.

May 13, 2024

A second law targets cleaning and resort fees at hotels and short-term rentals. Assembly Bill 537 , introduced by Assemblymember Marc Berman (D-Menlo Park), requires that lodgings display the total price before checkout, except any government taxes and fees.

The laws have already led to some national changes, including hotel websites that now display the total price for each stay before taxes, and a “total before taxes” search option on Airbnb.

President Biden last year called out junk fees and backed a bill in Congress that would ban the fees nationally. The Federal Trade Commission has also started drafting regulations that would bar companies from advertising prices without including mandatory fees.

Limits on security deposits

Many California landlords will be barred from charging more than the equivalent of one month’s rent for security deposits. Landlords could previously charge the equivalent of two times the monthly rent for unfurnished units, and three times the monthly rent for furnished units.

Assemblymember Matt Haney (D-San Francisco), who introduced AB 12 , said that high security deposits can be a barrier to finding affordable housing , especially in coastal California cities where rents are among the country’s highest.

Mom-and-pop landlords who own up to two rental properties, with no more than four units, are exempt from the law.

Newsom signs tenant bills to lower security deposits, prevent more evictions

California Gov. Gavin Newsom this year has signed several new tenant-protection bills into law, including a measure to lower security deposits. He also vetoed legislation to construct social housing projects.

Credit card codes for gun retailers

Starting July 1, credit card payment networks must provide a unique identifying code for gun and ammunition retailers. Those four-digit identifiers, known as “merchant category codes,” already appear on credit card statements for most types of businesses, including grocery stores, hotels and gas stations, and help payment networks offer rewards and track spending trends.

Typically, gun and ammunition retailers are categorized as sporting goods stores. Under AB 1587 , introduced by Assemblymember Phil Ting (D-San Francisco), credit card payment networks must begin offering the merchant category code for gun and ammunition retailers on July 1. Retailers have until May of next year to integrate the code into their systems.

Ting’s office said the code would allow banks to flag suspicious activity related to gun purchases, akin to the warnings that banks already pass along to law enforcement agencies about purchases potentially linked to terrorist financing, fraud and identity theft.

Date-rape drug testing kits in bars

Bars and nightclubs in California will be required to offer kits that test for controlled substances slipped into drinks.

The law will require bars and clubs to sell (or offer for free) strips, stickers, straws or other devices that test alcoholic drinks for the presence of common date-rape drugs, including ketamine, GHB and flunitrazepam, which is often sold under the brand name Rohypnol.

Drug-testing kits to be offered to patrons in California bars this summer

The drug-testing kits will allow patrons to test their drinks for date-rape drugs such as Rohypnol, also known as ‘roofies.’

March 26, 2024

AB 1013 , introduced by Josh Lowenthal (D-Long Beach), will also require bars and clubs to post “in a prominent and conspicuous location” a notice that reads: “Don’t get roofied! Drink spiking drug test kits available here. Ask a staff member for details.”

Tax on guns and ammunition

The sale of many firearms, ammunition and parts used to build guns will incur an 11% excise tax. The revenue from AB 28 will fund gun violence prevention and gang intervention programs in California. The federal government charges an excise tax on guns, but California’s is the first such tax at the state level.

The law, introduced by Assemblymember Jesse Gabriel (D-Encino), will not apply to sales to active and retired police officers and law enforcement agencies, nor to sales by mom-and-pop vendors who reported less than $5,000 in sales in the quarter when the purchase was made.

State budget analysts estimated that the tax would generate $159 million in revenue in the first year. If the excise tax is passed on by vendors to their customers, analysts said, the bill would generate additional sales and use tax revenue of up to $14 million for state and local governments.

Information on how to fix your iPhone

Manufacturers of many electronic devices and appliances will be required to provide the parts, tools and instructions needed to repair their products under a new law aimed at empowering consumers who are interested in fixing their own phones, dishwashers and lawnmowers.

Under SB 244 , the Right to Repair Act, manufacturers must make documents, parts and tools available to fix devices that cost $50 to $99 for at least three years after the product was last manufactured. For products that cost more than $100, the time period rises to seven years, regardless of warranty periods.

As software and technology gets infused in more and more products, manufacturers are increasingly making those products difficult to repair, potentially costing business owners time and money. Makers of products ranging from smartphones to farm equipment can withhold repair tools and create software-based locks that prevent even simple updates, unless they’re done by a repair shop authorized by the company. California is the third U.S. state, after New York and Minnesota, to pass a so-called right-to-repair law.

The law, introduced by state Sen. Susan Talamantes Eggman (D-Stockton), doesn’t apply to video game consoles, fire alarms and heavy machinery used in agriculture, forestry and construction.

7:03 AM PT -- Rick Ross doesn't seem pressed about last night's activities ... he tells TMZ that "Vancouver is a beautiful city and he can't wait to go back."

He also claims no one on his team suffered any serious injuries after the brawl ... all is fair in the 2024 Rap Wars???

Rick Ross had a rough night at his show in Canada ... getting into a physical altercation with some guy and triggering a melee that was captured on film.

It all started after the rapper performed at Sunday's Ignite Music Festival in Vancouver. After the gig around 10:30 PM, Rick stepped offstage into a crowded area and got into a heated argument with other men over their choosing to close out the set with Kendrick Lamar 's "Not Like Us" track blaring in the background.

We're told the group of about 15 dudes approached Rick and formed a human wall so he and his crew couldn't move around them.

TMZ obtained video showing the verbal confrontation between the two parties with Rick having a tense exchange with one of the men. It soon escalated into violence.

Check out the clip ... the dude arguing with Rick suddenly slugs him in the area around his head, causing liquid from his drink to fly into the air. From our vantage point, it's hard to tell if Rick was punched square in the face.

Chaos erupted as the two groups got into a brawl, leading to several men brutally kicking another guy and beating him with their fists.

Our sources say the fight eventually broke up and everyone went their separate ways.

It's unclear what sparked the attack or if anyone was injured or arrested. We've reached out to the authorities for an update.

As for Rick, we're not sure what happened to him either. We contacted his rep, who did not have a comment.

However, Drake, AKA "champagnepapi," offered his two cents, liking a social media post on X about Rick's assault.

Here’s What the Court’s Chevron Ruling Could Mean in Everyday Terms

The decision is expected to prompt a rush of litigation challenging regulations across the entire federal government, from food safety to the environment.

The Supreme Court’s decision on Friday to limit the broad regulatory authority of federal agencies could lead to the elimination or weakening of thousands of rules on the environment, health care, worker protection, food and drug safety, telecommunications, the financial sector and more.

The decision is a major victory in a decades-long campaign by conservative activists to shrink the power of the federal government, limiting the reach and authority of what those activists call “the administrative state.”

The court’s opinion could make it easier for opponents of federal regulations to challenge them in court, prompting a rush of new litigation, while also injecting uncertainty into businesses and industries.

“If Americans are worried about their drinking water, their health, their retirement account, discrimination on the job, if they fly on a plane, drive a car, if they go outside and breathe the air — all of these day-to-day activities are run through a massive universe of federal agency regulations,” said Lisa Heinzerling, an expert in administrative law at Georgetown University. “And this decision now means that more of those regulations could be struck down by the courts.”

The decision effectively ends a legal precedent known as “Chevron deference,” after a 1984 Supreme Court ruling. That decision held that when Congress passes a law that lacks specificity, courts must give wide leeway to decisions made by the federal agencies charged with implementing that law. The theory was that scientists, economists and other specialists at the agencies have more expertise than judges in determining regulations and that the executive branch is also more accountable to voters.

Since then, thousands of legal decisions have relied on the Chevron doctrine when challenges have been made to regulations stemming from laws like the 1938 Fair Labor Standards Act, the 1970 Clean Air Act , the 2010 Affordable Care Act and others.

In writing laws, Congress has frequently used open-ended directives, such as “ensuring the rule is in the public interest,” leaving it to agency experts to write rules to limit toxic smog, ensure that health plans cover basic medical services, ensure the safety of drugs and cosmetics and protect consumers from risky corporate financial behavior.

But that gave too much power to unelected government officials, according to conservatives, who ran a coordinated, multiyear campaign to end the Chevron doctrine. They believe the courts, not administrative agencies, should have the power to interpret statutes. The effort was led by Republican attorneys general, conservative legal activists and their funders, several with ties to large corporations, and supporters of former President Donald J. Trump.

“Overturning Chevron was a shared goal of the conservative movement and the Trump administration. It was expressed constantly,” said Mandy Gunasekara, who served as chief of staff at the E.P.A. under President Trump and has helped write Project 2025 , a policy blueprint for a next Republican administration. “It creates a massive opportunity for these regulations to be challenged. And it could galvanize additional momentum toward reining in the administrative state writ large if the administration changes in November.”

Still, Jonathan Berry, who served as a senior Labor Department official under Mr. Trump, noted that overturning the Chevron doctrine itself “doesn’t immediately blow anything up.”

Rather, Mr. Berry said, the fate of the regulations will be determined by what happens when they start moving through the courts without the protection of Chevron. “The mystery is exactly how much of this stuff goes down,” Mr. Berry said.

Here is a look at how the decision might affect various government agencies.

The Environmental Protection Agency

Environmentalists fear that the end of the Chevron doctrine will mean the elimination of hundreds of E.P.A. rules aimed at limiting air and water pollution, protecting people from toxic chemicals and, especially, tackling climate change.

Over the past six months, the Biden administration has issued the most ambitious rules in the country’s history aimed at cutting climate-warming pollution from cars , trucks , power plants and oil and gas wells . Without those rules, it would very likely be impossible for President Biden to achieve his goal of cutting greenhouse gas emissions in half by the end of the decade, which analysts say all major economies must do to avoid the most deadly and catastrophic impacts of global warming.

All of the Biden climate rules have already been the target of lawsuits that are winding their way through the courts.

Legal experts say that the reversal of Chevron will not remove E.P.A.’s foundational legal obligation to regulate climate-warming pollution: that was explicitly detailed in a 2007 Supreme Court decision and in 2022 legislation passed by Democrats in anticipation of challenges to that authority.

But the specific regulations — such those designed to cut car and truck pollution by accelerating the transition to electric vehicles, or to slash power plant pollution with the use of costly carbon capture and sequestration technology — could now be more legally vulnerable.

The result would quite likely be that stringent climate rules designed to sharply reduce emissions could be replaced by much looser rules that cut far less pollution. Experts say that could also be the fate of existing rules on smog, clean water and hazardous chemicals.

Labor Agencies

The elimination of the Chevron deference could affect workers in a variety of ways, making it harder for the government to enact workplace safety regulations and enforce minimum wage and overtime rules.

One recent example was in April, when the Biden administration raised the salary level below which salaried workers automatically become eligible for time-and-a-half overtime pay, to nearly $59,000 per year from about $35,000, beginning on Jan. 1. Business groups have challenged the Labor Department’s authority to set a so-called salary threshold and such challenges will have far better odds of success without the Chevron precedent, experts said.

The shift could also rein in protections for workers who publicly challenge the policies of their employers, according to Charlotte Garden, a professor of labor law at the University of Minnesota. The National Labor Relations Board often concludes that a single worker has the right to protest low pay or harassment or attendance policies without being disciplined or fired. But the relevant law refers to “concerted activities,” meaning the protection may now apply only to groups of employees who stage such protests, not individuals, Professor Garden said.

Food and Drug Administration

The Food and Drug Administration flexes significant power when it sets the standards for how new drugs must be studied and whether they are safe and effective before they are approved for use. Attorneys who worked at the agency said that companies chafing at that high bar for approvals might now challenge those regulations. Others said legal challenges could ultimately affect drug prices.

Challenges are also expected in the agency’s tobacco division, which authorizes the sale of new cigarettes and e-cigarettes with the intent to protect public health. “I would expect the industry to attack the F.D.A.’s authority to do premarket review at all,” said Desmond Jenson, deputy director of the commercial tobacco control program at the Public Health Law Center.

Others noted the Chevron decision could have a chilling effect, compelling the F.D.A. to proceed quite carefully, given the potential for litigation, if it moves forward with proposals to ban menthol cigarettes or make them less addictive by slashing nicotine levels.

Abortion opponents say the ruling could work in their favor as they seek to bring another case against the Food and Drug Administration’s approval of an abortion medication to the Supreme Court, which rejected their effort to undo the agency’s approval of the drug this month.

Kristi Hamrick, a strategist for Students for Life of America, an anti-abortion organization, said in a statement that such a case was likely to get a better reception “when the F.D.A. is no longer given the benefit of the doubt.”

Health Care

The court’s ruling could affect how Medicare, Medicaid and Affordable Care Act insurance plans are administered, health law experts said, as opponents gain an opportunity to challenge how these huge programs operate.

The health care system is governed by elaborate regulations covering how hospitals operate, what providers are paid for medical services and how insurance companies are monitored by the government. Much of that regulation is grounded in interpretation of laws that date back decades. Major industries could be affected if rules are changed.

“There’s an awful lot of regulation that flies under the radar that’s just about making sure the trains run on time,” said Nicholas Bagley, a law professor at the University of Michigan.

Rachel Sachs, a health law expert at the Washington University School of Law in St. Louis, said that the complex set of rules devised and governed by the Department of Health and Human Services and the Centers for Medicare and Medicaid Services could be challenged in new ways.

“There’s a lot of work to do in that process,” she said. “And therefore there are a lot of opportunities for challengers to pick at specific choices that C.M.S. and H.H.S. are making in the interpretation of these rules.”

The Supreme Court decision will require Congress to specify exactly what agencies like the C.D.C. can and cannot do, several analysts said. “Nobody has any confidence that Congress can get its act together to do that,” said Dr. Georges C. Benjamin, executive director of the American Public Health Association.

“I think the decision as written solidifies employment for lawyers and judges, and undermines the authority of experts,” he added.

Other scientists also expressed doubt that Congress or the judiciary could remain abreast of constantly evolving scientific evidence. “To keep up with that pace of change, even for a medical or scientific professional, is very challenging,” said Karen Knudsen, chief executive of the American Cancer Society.

The Biden administration has written health regulations anticipating a world without the Chevron deference, said Abbe R. Gluck, a health law expert at Yale Law School who served in the White House at the beginning of Mr. Biden’s term. For that reason, she thinks litigation over the most recent rules may be less influenced by this change than challenges concerning some older regulations.

“The Supreme Court has not relied on Chevron in quite a few years,” she said. “So the federal government, including H.H.S., has become accustomed to drafting regulations and making its interpretation arguments as if Chevron did not exist.”

“They’ve already adjusted,” Ms. Gluck said.

Treasury and the Internal Revenue Service

The Treasury Department and the Internal Revenue Service both have broad mandates to interpret legislation when they write rules and regulations and enforce the tax code.

Since the Inflation Reduction Act passed in 2022, the Treasury Department has been racing to roll out regulations related to billions of dollars of clean energy tax credits that provide huge incentives for things such as the manufacturing of batteries or the purchase of electric vehicles. The Treasury Department has received pushback from some lawmakers who contend that it has not followed the intent of the law.

Although Congress creates the tax code through legislation, the I.R.S. has wide latitude in how the tax laws are administered. Accounting experts have suggested that the court’s ruling could complicate the agency’s ability to administer the tax code without specific direction from Congress.

A recent example is how the agency last year delayed enforcement of a contentious tax policy that would require users of digital wallets and e-commerce platforms to report small transactions. The new provision was introduced in the tax code in 2021 but was strongly opposed by lobbyists and small businesses.

The I.R.S. received criticism from some lawmakers for delaying the policy, but the agency defended its decision by arguing that taxpayers needed a longer transition period before the measure should be enforced to avoid a chaotic tax season.

Family demands accountability for police killing of 13-year-old allegedly carrying replica gun

(AP) - On Wednesday, Nyah Mway finished middle school in the central New York city where his family moved about a decade ago as refugees from Myanmar, relatives said.

By Friday night, the 13-year-old was fatally shot by police who’d tackled him to the ground after he allegedly pointed what turned out to be a BB gun at them during a foot chase.

Struggling to comprehend his death, his anguished relatives and outraged members of their immigrant community called Sunday for justice for him and accountability for police.

Nyah Mway, 13, was fatally shot by police who’d tackled him to the ground after he allegedly...

“We came to the United States, finally, to get the education and to get the good jobs here” and hoping for a peaceful life after decades of strife and violence in Myanmar, said Lay Htoo, who identified himself as one of Nyah’s cousins.

But instead of celebrating the teen’s ascent to high school, his parents were waiting for medical examiners to release his body and wondering what would become of the officers.

“They want them to be in prison forever,” the cousin said in a phone interview.

As the state attorney general and the Utica Police Department investigate the shooting, Nyah’s relatives and other local members of Myanmar’s Karen ethnic minority said they planned to meet Sunday afternoon with Utica Mayor Michael P. Galime. A message seeking comment was sent to the mayor’s office.

For now, the officers are on paid administrative leave.

The shooting happened Friday night in Utica, an old industrial city where thousands of refugees from various countries have settled in recent decades, creating a measure of revival in a faded Rust Belt hub. The city’s population of 65,000 includes more than 4,200 people from Myanmar, according to The Center , a nonprofit group that helps to resettle refugees.

GRAPHIC WARNING: Video in this story includes disturbing content.

According to police, Nyah and another 13-year-old boy were stopped Friday night because they fit descriptions of suspects in an armed robbery that had happened Thursday in the same area, and because one teen was jaywalking. The police department declined Sunday to release the armed robbery report and its suspect description, citing the ongoing investigation.

The body camera video shows an officer saying he needs to pat them down for any weapons. Then one of the teens — identified as Nyah — runs away, turns and appears to point a black item at them.

The officers believed it was a handgun, police said, but it was later determined to be a BB or pellet gun that closely resembled a Glock 17 Gen 5 handgun with a detachable magazine. Police released an image showing the device did not have an orange band on the barrel that many BB gun-makers have added in recent years to distinguish their products from firearms.

Officer Bryce Patterson caught up with Nyah, tackled and punched him, and as the two wrestled on the ground, Officer Patrick Husnay opened fire, body camera video showed. Utica Police Chief Mark Williams said at a news conference Saturday that the single shot hit the youth in the chest.

A bystander video posted to Facebook also showed an officer tackling the teen and punching him as two other officers arrive, then a gunshot ringing out as the teen was on the ground.

Under New York law, the attorney general’s office looks into every death at the hands of law enforcement. The police department’s own probe will explore whether officers followed policies and training.

Williams called the shooting “a tragic and traumatic incident for all involved, and his department said it released information and the body camera video in keeping with “our commitment to transparency.”

To Nyah’s cousin, Isabella Moo, however, the police narrative seemed like “trying to criminalize him a lot more and trying to protect the police officers.”

“The escalation of this should not have happened, and our police officers need to be trained a lot better or a lot differently,” she said in a phone interview. “The city needs to be held accountable, and this should not have been done to any child.”

Karens are among groups warring with the military rulers of Myanmar, the Southeast Asian country formerly known as Burma. The army ousted the elected government of Aung San Suu Kyi in 2021 and suppressed widespread nonviolent protests that sought a return to democratic rule.

Nyah’s family fled about two decades ago from Myanmar to Thailand, where he was born in a refugee camp, and then immigrated through a resettlement program to the United States about nine years ago, Htoo said. He said the teen’s father works at a convenience store.

Htoo said Nyah was keen on math, soccer and spending time with friends when not caring for his younger siblings. Interested in learning, he sometimes attended Bible study with his friends, though his family are Buddhists, the cousin said.

The cousin said he’d been told that on Friday night, the boy informed his mother he was going to a store to buy something, and that was the last she saw of him.

She hasn’t slept since, except for 10-minute naps, her tears resuming every time she awakens, he said.
