What is presidential immunity? Supreme Court ruling broadens definition in Trump v. United States ruling
![pronunciation of voyage and meaning](https://www.usatoday.com/gcdn/presto/2023/01/23/PMUR/95cb6ddd-7ddc-44c5-9e95-652f5b073d99-Joyce_Orlando.jpg?crop=303,303,x118,y0&width=48&height=48&format=pjpg&auto=webp)
On Monday, the Supreme Court ruled that former President Donald Trump is immune from prosecution for his “official acts” in office. Well, at least for some of them. Just what does that mean?
Trump v. United States was brought before the court to determine if prosecutors could seek charges against Trump for trying to overturn the 2020 election or if he would be immune from prosecution because he was the sitting president at the time. The court ruled, in a 6-3 vote, that presidents are in fact shielded from prosecution for official acts, but they weren't as clear on questions raised about Trump's role in reported election interference and the Jan. 6 Capitol riot.
That decision they saved for the judge in the federal case to rule on, with Chief Justice John Roberts writing , "That analysis ultimately is best left to the lower courts to perform in the first instance."
Many of us know that presidents have some form of immunity while they are president, but here's what it entails and what the Supreme Court's decision means in the ongoing Trump prosecution and trials.
What is presidential immunity?
There is nothing in the Constitution that gives presidents immunity in civil or criminal legal proceedings, but there have been other Supreme Court decisions that have set the precedent of what we think of as presidential immunity.
Prep for the polls: See who is running for president and compare where they stand on key issues in our Voter Guide
Presidential immunity is when a sitting president has both civil and criminal immunity for actions relating to the official duties of the president, including those in the "outer perimeter" of those duties. This immunity does not extend to unofficial conduct, criminal conduct and conduct occurring before becoming president.
According to Congress.gov , a 1867 Supreme Court decision in Mississippi v. Johnson , established that the president is largely beyond the judiciary's reach by, "holding that it could not direct President Andrew Johnson in how he exercised his 'purely executive and political powers.' The Court stated, it had 'no jurisdiction . . . to enjoin the President in the performance of his official duties.'"
But that decision didn't mean a president was immune to all judicial processes.
When it comes to lawsuits, sitting presidents are immune from being part of them, but in cases ― like in former President Richard Nixon's Watergate scandal― the Supreme Court has ruled that presidents have to provide documents and may have to appear in court during the legal proceedings.
What does the Supreme Court's case mean for Trump's presidential immunity claim?
The ruling in Trump v. United States states that Trump is entitled to immunity from criminal prosecution for conduct that is part of "official” acts as president but not "unofficial" acts he took as a candidate.

India announces definition of Green Hydrogen Green Hydrogen Standard for India specifies emission threshold of 2 kg CO2 equivalent / kg H2 as 12-month average
In a significant move for the progress of the National Green Hydrogen Mission , the government has notified the Green Hydrogen Standard for India. The standard issued by the Ministry of New and Renewable Energy (MNRE), Government of India outlines the emission thresholds that must be met in order for hydrogen produced to be classified as ‘Green’, i.e., from renewable sources. The scope of the definition encompasses both electrolysis-based and biomass-based hydrogen production methods.
After discussions with multiple stakeholders, the Ministry of New & Renewable Energy has decided to define Green Hydrogen as having a well-to-gate emission (i.e., including water treatment, electrolysis, gas purification, drying and compression of hydrogen) of not more than 2 kg CO 2 equivalent / kg H 2 .
The notification specifies that a detailed methodology for measurement, reporting, monitoring, on-site verification, and certification of green hydrogen and its derivatives shall be specified by the Ministry of New & Renewable Energy.
The notification also specifies that the Bureau of Energy Efficiency (BEE), Ministry of Power shall be the Nodal Authority for accreditation of agencies for the monitoring, verification and certification for Green Hydrogen production projects.
The notification of the Green Hydrogen Standard brings a lot of clarity to the Green Hydrogen community in India and was widely awaited. With this notification, India becomes one of the first few countries in the world to announce a definition of Green Hydrogen.

Trump catches another break with Supreme Court ruling on presidential immunity
The decision was the latest in a string of favorable developments for the presumptive Republican nominee.
![pronunciation of voyage and meaning](https://www.washingtonpost.com/wp-apps/imrs.php?src=https://s3.amazonaws.com/arc-authors/washpost/c92633a1-cfd2-407a-bffb-245ff4e5f5ea.jpg&w=196&h=196)
The Supreme Court’s Monday ruling on presidential immunity was the latest in a string of favorable developments for Donald Trump , who once faced mounting questions about how he’d balance time in court with campaigning for a return to office.
The 6-3 decision, which pointed to further legal delays for the former president, came as his opponent, President Biden , confronted a campaign crisis after a widely panned debate performance last week. Less than 24 hours after that debate, the Supreme Court ruled that federal prosecutors improperly charged a defendant over the Jan. 6 , 2021, attack on the U.S. Capitol and overturned a 40-year-old legal precedent that conservatives have long targeted.
Monday’s ruling sparked some concern from critics about potential implications in a second Trump term, with Biden saying Trump would only be further emboldened. But with two weeks until the scheduled start of the Republican nominating convention, Trump confidently embraced the decision — with three justices he nominated helping form the majority opinion — after months of griping about his legal cases.
“Trump has had a lot of really good luck. His campaign couldn’t have written a better few days,” Republican strategist Alex Conant said. “Legally he still has issues, but politically he’s able to claim vindication and nobody will see him in a federal court before the election.”

Trump still faces some challenges. He is in uncharted territory running as a felon facing a polarized electorate and has alienated many voters with his false claims and combative tone on the campaign trail. He has repeatedly claimed that he is the victim of a weaponized judicial system, even though there’s no evidence of coordination between the White House and prosecutors in his cases.
But for now, according to The Washington Post presidential polling averages, Trump is narrowly leading Biden nationally and in six of seven key states.
The Monday decision that former presidents are immune from prosecution for official actions taken while in the White House, but not from unofficial acts, further complicates the timing of Trump’s D.C. trial, potentially extending the case until after the election by sending it back to a lower court. The former president faces four federal felony counts for allegedly trying to reverse Biden’s 2020 victory.
“BIG WIN FOR OUR CONSTITUTION AND DEMOCRACY. PROUD TO BE AN AMERICAN!” Trump wrote on social media. He later described the decision as “BRILLIANTLY WRITTEN AND WISE” and predicted, without presenting evidence, that many of the his legal cases "WILL NOW DISAPPEAR, OR WITHER INTO OBSCURITY.”
In a win for conservatives last week, the Supreme Court curtailed federal agency power by reversing Chevron , a 40-year-old legal precedent that said courts should defer to an agency’s reasonable interpretation of the law. In a separate ruling , the court found that prosecutors improperly charged a defendant with obstruction in the Jan. 6, 2021, attack on the U.S. Capitol, a development Trump’s legal team might use to help defend him in court.
Meanwhile, Trump’s campaign has experienced an influx of donations after his May 30 conviction in New York on 34 felony counts of falsifying business records to cover up a payment to an adult-film actress — essentially erasing the cash advantage Biden and the Democratic National Committee held.
While Trump is claiming complete immunity, a lower court will decide which acts count as official or unofficial. The case is expected to continue to move forward as the former president campaigns.
Democrats and some legal experts expressed concern about the scope of the Supreme Court decision and the implications it could have for an emboldened Trump, should he win a second term.
Biden criticized the decision Monday evening calling it a “dangerous precedent.”
“This is a fundamentally new principle, and it’s a dangerous precedent, because the power of the office will no longer be constrained by the law, even including the Supreme Court.”
Biden also warned that Trump would be "more emboldened to do whatever he pleases whenever he wants to do it.”
Norman Eisen, senior fellow in Governance Studies at Brookings, said in an interview that “every American is in more danger today because they have rewritten and restructured our checks and balances and dramatically expanded the power of the presidency.”
The Supreme Court decision caps months of uncertainty over how Trump’s legal entanglements would affect his campaign. He was found guilty in his New York hush money trial, becoming the first former U.S. president convicted of a crime. Federal prosecutors have also charged Trump with illegally hoarding classified documents, but that trial has been postponed indefinitely. Trump also faces state charges in Georgia for trying to undo election results in that state.
“If you’re the Trump legal team, you’re thrilled with this decision because it gives the opportunity to really delay the Jan. 6 trial so there’s no way it’s tried in 2024,” said John Fishwick, a former federal prosecutor.
However, he noted that “there will be a number of hearings rehashing what happened in 2021 on Jan. 6 and all around that time frame. So it’s all going to be relitigated in some way.”
Ty Cobb, a former Trump White House lawyer who has since turned critic, said that while Trump benefited from the Supreme Court’s decision, the ruling itself wasn’t about the former president.
“Is it a win for Trump? You can’t really say it isn’t," Cobb said. "In terms of what the work was that went into this and the decision that had to be made, it wasn’t a Trump-specific decision. It was a presidency-specific decision of which he was the decided beneficiary.”
Nicole Markus, Ann Marimow and Scott Clement contributed to this report.
More on the Trump Jan. 6 case
The latest: What is presidential immunity? The Supreme Court ruled that former president Donald Trump is immune from prosecution for his “official acts” in office. Here are key takeaways from the Supreme Court’s immunity decision and what’s next in Trump’s case with special counsel Jack Smith .
The trial: The Supreme Court’s immunity decision likely means that Donald Trump’s federal trial can eventually proceed in D.C., but only after additional delay. The March 4 trial date was taken off the calendar and jury selection was postponed indefinitely.
The charges: Trump pleaded not guilty to charges that he plotted to overturn the 2020 election in the run-up to the Jan. 6, 2021, attack on the U.S. Capitol. Here’s a breakdown of the charges against Trump and what they mean, and things that stand out from the Trump indictment .
The case: The special counsel’s office has been investigating whether Trump or those close to him violated the law by interfering with the lawful transfer of power after the 2020 presidential election or with Congress’s confirmation of the results on Jan. 6, 2021. It is one of several ongoing investigations involving Trump .
Can Trump still run for president? While it has never been attempted by a candidate from a major party before, Trump is allowed to run for president after being indicted in four criminal cases and following a conviction in one of them. The three other cases are pending.
