Key defendant in 'Trump Train' trial testifies: 'I stand hardcore for my flag'

In fiery testimony, a San Antonio man accused of conspiring to block a Joe Biden-Kamala Harris campaign bus in 2020 said he was motivated by patriotism and the belief that Democrats are trying to "destroy our country" to organize what he maintained was a straightforward protest.

Speaking before the jury in a federal court in Austin on Thursday, Navy veteran Eliazar Cisneros denied claims that he and other "Trump Train" participants intended to prevent the bus passengers from campaigning when they surrounded it Oct. 30, 2020, on Interstate 35 in Central Texas, forcing the vehicle to move as slowly as 15 mph on a highway with a speed limit of 70 mph.

"I don't get y'all trying to paint me out to be this horrible person when I'm not," Cisneros said, tearing up as he addressed the plaintiffs. "I'm unbelievably patriotic. I love my country unbelievably. I stand hardcore for my flag, and I love it. And when you have people that just try to destroy our country, that hurts. It hurts me."

Cisneros, who sideswiped the car of a college-aged Biden campaign staffer who was following the bus, also maintained that he did not cause that minor collision.

Cisneros is a defendant in a lawsuit that former state Sen. Wendy Davis, former Biden staffer David Gins and bus driver Timothy Holloway filed against six "Trump Train" drivers under the Ku Klux Klan Act , an 1871 federal law that forbids two or more people from conspiring to use violence, intimidation or harassment to prevent a citizen from engaging in political support or advocacy.

All three plaintiffs testified this week that they feared for their lives during the more than 90 minutes they were blockaded by the convoy headed north from San Antonio to Austin on I-35, and all said they suffered lingering symptoms of anxiety for months after the incident. The plaintiffs, who also canceled the tour's Austin campaign stop as a result of the incident, are seeking punitive and compensatory damages as well as attorneys' fees in the case, over which Judge Robert Pitman of the federal Western District of Texas is presiding.

The plaintiffs have focused on Cisneros as a primary organizer of the "Trump Train" rally through text messages and email evidence presented at trial, which show he directed several participants to wait for the bus at an exit in San Antonio. One email note that Cisneros wrote to himself says he and Jerry Peña planned the gathering when they saw that the bus would stop in San Antonio.

Robert Meyer, an attorney for the plaintiffs, showed Cisneros wrote that he was “smart enough to get the entire Biden-Harris campaign canceled in Texas" in a Facebook Messenger exchange after the highway confrontation. The exhibit, which Cisneros confirmed, showed he was responding to a message that read, "You're not very smart, are you?"

Meyer also assailed Cisneros' credibility throughout the cross-examination. He noted Cisneros claimed to have lost the cellphone he used during the 2020 incident until Pitman ordered him to recover it. Cisneros responded to Meyer saying he had trouble finding his phone because his mother, whom he lives with, hid it from his brother, a heroin addict, in the house.

The judge also sanctioned Cisneros in a prior hearing for deleting messages related to the event. Questioned about what evidence might have been destroyed in this process, Cisneros said he wished the messages still existed because he has "nothing to hide."

Meyer also depicted Cisneros as having a history of using his vehicle for political intimidation when he presented a video of Cisneros driving into a small group of Black Lives Matter protesters in San Antonio in 2020.

In the video, protesters screamed as Cisneros drove up to the crowd. "Get the f--- off the road!" he shouted, then drove off. Cisneros said he "knew" they were protesting in the road "illegally" without a permit.

Under cross-examination, Cisneros also admitted that he had planned to bring bear mace and collapsible batons to the Jan. 6, 2021, protests against election certification in Washington, D.C., though he didn't follow through on that plan. Cisneros and two fellow defendants in the case — New Braunfels pastor Steve Ceh and his wife, Brandi Ceh, who works at Hallmark — were in the nation's capital on Jan. 6, 2021, as per testimony and court filings.

While Meyer did not question the defendant about his political views, Cisneros repeatedly returned to the theme of politics in impassioned diatribes, suggesting he was being sued because of his conservative views.

In doing so, Cisneros sought to reinforce the argument made by his attorney , Tea Party Republican and former U.S. Rep. Francisco Canseco, who suggested the lawsuit was part of a national strategy to deplete Republicans' financial resources through "lawfare."

However, Pitman ruled that a jury could reasonably find that Cisneros and the other defendants had illegally intimidated the plaintiffs in his order denying summary judgment .

"Statements by ... defendants like Cisneros that Plaintiffs should be served '35 in tires,' ... accompanied by the driving tactics described above, could reasonably be considered threats," Pitman wrote. "Such evidence, if accepted by a jury, would fall well within the type of forceful, intimidating, or threatening behavior that Congress sought to prohibit when it enacted the Klan Act."

After several hours of questioning Thursday, Meyer compared the Trump Train's surrounding of the Biden campaign bus on I-35 to a congregation of wolves closing in on prey, then attacking after one wolf howls.

"Weren't you the howler in this case, Mr. Cisneros?" Meyer asked.

Cisneros said the analogy was "horrible," but he didn't directly deny the allegation.

"I know what's important to me," Cisneros added in a long response. "I know how beautiful it is to be American. I know the divisiveness (of the) Democratic Party. ... So when I see these type of people, I want to speak out. I want to let people know what's important to us. And I think I have that right as an American to protest what they believe is right to them, and what's right to me is right here and the protection of this country."

Cisneros' testimony will continue when the trial resumes Monday. The case is expected next week to go to the jurors, who will decide on the plaintiffs' claim that the defendants conspired in violation of the Klan Act.
