Beaconsfield man jailed for 'awful' sexual assaults on 'vulnerable' people

A 55-year-old man from Beaconsfield has been sentenced to nearly a decade behind bars for sexually assaulting three people.

Richard Cunningham, of Maxwell Road, was found guilty of sexually assaulting three people by a jury on February 28, following a week-long trial at Aylesbury Crown Court.

He was also found guilty of assault by penetration and not guilty of one count of rape in relation to offences committed in Chalfont St Peter between 2015 and 2019.

Cunningham was sentenced to eight-and-a-half years in prison on Friday, April 19.

The 55-year-old also previously pleaded guilty to assaulting an emergency worker after her pushed a female police officer to the ground on Maxwell Road, causing a head injury that required hospital treatment.

Detective Inspector Christopher Birtles said: “The three victims in this case were brave and resolute and this conviction shows their determination to see not only justice for what happened but also to prevent it from happening to anyone else.

“Richard Cunningham preyed on these vulnerable victims and the sentence he received reflects the awful nature of the crimes he committed.

“I hope this case shows that we will always support victims of sexual offences and do all we can to put offenders before the courts.

“We also simply will not accept assaults on our dedicated and hardworking police officers while serving the public so I’m glad Cunningham has also been brought to justice for this offence.”

Convicted Tri-State Area Serial Killer Dubbed 'Torso Killer' Confesses To Five Long Island Murders

DNA connected Richard Cottingham to the 1968 murder of Diane Cusick. As part of a plea deal, Cottingham has now confessed to the murders of Mary Beth Heinz, Laverne Moye, Sheila Heiman and Marita Rosado Nieves.

Convicted serial killer Richard Cottingham has confessed to five murders after striking a plea deal in the case of a murdered Long Island mother.

Cottingham, 76, who is already serving life at a New Jersey state prison, appeared virtually at a Nassau County courthouse in Mineola, New York on Monday, pleading guilty to the 1968 murder of Diane Cusick, 23, according to the Associated Press .

During the hearing, Cottingham also admitted to killing four additional women on Long Island, for which he was granted immunity from prosecution as part of the plea deal.

Cottingham was indicted on second-degree murder charges in June for Cusick’s murder and has now admitted to the 1970s murders of Mary Beth Heinz, 21, Laverne Moye, 23, Shiela Heiman (sometimes spelled Hyman), 33, and Marita Rosado Nieves, 18, Long Island’s News 12 reported.

Judge Caryn Fink sentenced Cottingham to a 25-year term in accordance with the plea deal, adding, “There are no words to describe how purely evil you are,” CNN reported.

“Today is one of the most emotional days we’ve ever had at the Nassau County District Attorney’s Office,” added District Attorney Anne Donnelly, according to NBC News .

Cottingham, appearing in a hospital gown and reportedly in ailing health, chose not to speak at Monday’s court hearing, News 12 reported.

Cusick’s daughter, who was just 4 years old at the time of her mother’s murder, was also present in the Minolta courtroom, according to CBS News .

“He just had this, like, dead stare,” Darlene Altman told reporters. “I felt like he was looking right at me. It was creepy.”

Cottingham is already serving life for murdering five victims killed in the tri-state area since the 1960s, according to NBC New York City affiliate WNBC .

Cottingham — whose terror earned him the moniker “The Torso Killer” and “The Times Square Killer” — has confessed to more than 100 homicides over the years, though investigators have only linked him to about a dozen killings.

Prosecutor Jared Rosenblatt wept when addressing the victims’ families after Cottingham’s sentence was handed down, according to the New York Post .

“I hope there is some justice for all of you knowing that for the rest of this defendant’s life, [he] will live and take every breath in a prison cell in New Jersey,” said Rosenblatt. “I hope today will bring you the closure that you all sought for the past 50 years.”

Cusick, a New Hyde Park dance instructor, vanished on the evening of Feb. 15, 1968, after telling her parents she was going to the Green Acres Mall in Valley Stream to buy a pair of dancing shoes, according to the Nassau County District Attorney’s Office . When Cusick’s parents went to look for their daughter, they found a beaten and strangled Cusick in the backseat of her Plymouth, which was still parked in the mall parking lot.

Investigators believed Cottingham presented himself as a security guard and accused Cusick of stealing before finally overpowering the 98-pound woman, according to the Associated Press.

DNA connected Cottingham to Cusick’s murder earlier this year.

On Monday, Cusick’s brother, Jim Martin, said he was sure his sister tried to fight her killer off, referring to Cottingham as an “animal,” according to the New York Post.

“He punched her in the face, put tape over her mouth and nose, and then raped her,” said Martin before directing his attention to Cottingham. “I just wish my brother Bobby and I would have found you in the streets, and we would have torn you apart.”

Cottingham is now claiming responsibility for the May 10, 1972 homicide of Mary Beth Heinz and the June 20, 1972 homicide of Laverne Moye, according to News 12. Both victims were strangled to death, their bodies thrown from the Peninsula Boulevard bridge in Rockville Centre — about 30 miles east of Manhattan.

Shiela Heiman was found dead by her husband at their affluent Woodmere, Long Island home on July 20, 1973.

According to a 1973 New York Times article, the crime scene was so bloody that it took investigators hours to determine that the mother of three was beaten to death with a blunt instrument.

On Dec. 27. 1973, about five months after Heiman’s murder, Marita Rosado Nieves was found strangled to death at the East Bathhouse bus stop on Ocean Parkway near Jones Beach, according to News 12.

Nassau County officials will not prosecute Cottingham for the four Long Island murders, per the plea agreement.

Cottingham’s crimes were the focus of the 2021 Netflix series “Crime Scene: The Times Square Killer ,” which detailed the gruesome murders of two sex workers found decapitated and burned in a motel room in 1979, for which Cottingham was convicted .

Authorities caught onto Cottingham in 1980 after a Hasbrouck Heights , New Jersey motel employee heard screaming and found one of Cottingham’s survivors tied to the bed, having sustained bite marks and knife wounds, according to the Associated Press .

Cottingham was later convicted for the murders of Valorie Street, 18, and Maryanne Carr, 28, in New Jersey, as well as the 1980 murder of Ann Renyer in New York City, according to a 1984 article from the New York Times .

Cottingham also pleaded guilty in 2021 to the murders of friends Mary Ann Pryor, 17, and Lorraine Kelly, 16, who disappeared in August 1974 after making plans to go to a Paramus, New Jersey mall to purchase bathing suits. Cottingham confessed to raping the teens for days before drowning them in a motel room bathtub and leaving their bodies in a wooded area near Montvale.

“Richard Cunningham killed who[m] he wanted when he wanted because he’s a serial killer,” said District Attorney Donnelly, per CNN.

At the time of the murders, Cottingham was a computer programmer for a New York-based health insurance company and a father of three children.

News | DEFENSE ATTORNEY FATALLY STABBED BY SON, POLICE SAY

Chicago Tribune

Richard Cunningham, 56, who in 1999 helped clear a man after eight years on Death Row, was allegedly attacked by his son, Jesse, in the kitchen of the elder Cunningham’s home in the 3400 block of North Janssen Avenue in the Lakeview neighborhood, police said.

The son, Jesse, 26, who suffers from depression and schizophrenia, drove Thursday to the Janssen Avenue home where his parents live and was talking with his father in the kitchen when, at around 1 p.m., without warning he allegedly grabbed a steak knife and began repeatedly stabbing his father in the head, chest and back, police said.

“There was no argument, zero arguing,” said one detective. “He had no idea it was coming.”

The ensuing struggle spilled onto the front porch where, authorities said, someone saw what was happening and called police. Richard Cunningham, who also has two daughters, was taken by a neighbor to Illinois Masonic Medical Center, where he was pronounced dead at about 3 p.m.

Jesse Cunningham was arrested outside the home and taken to the Belmont Area headquarters, where he was charged late Thursday with first degree murder. He is expected to appear Friday for a bond hearing in the Criminal Courts building at 2600 S. California Ave.

Police said the younger Cunningham made a statement implicating himself in the stabbing.

“Dick Cunningham was the most tenacious of lawyers,” said attorney Locke Bowman, who worked with Cunningham on perhaps his signature case, the 1999 release of Ronald Jones from Illinois’ Death Row.

“He absolutely never gave up.”

Mainly on the strength of a confession he says was beaten out of him, Jones was convicted in 1989 for the murder and rape four years earlier of a 28-year-old mother of three whose body was found on the South Side.

A Cook County Circuit judge ridiculed Cunningham’s request that DNA tests be done on semen found at the scene, but Cunningham won that battle and in 1997 the tests proved that Jones was not the source. After eight years on Death Row, Jones was exonerated in 1999, even though the Cook County state’s attorney’s office continued to insist he was a suspect in the case.

“Dick saved Ronald Jones’ life,” Bowman said.

Cunningham was also instrumental in winning a new hearing for Ronald Kitchen, who was convicted in 1990 and sent to Death Row after confessing to the 1988 drug-related murders of five people. Kitchen, whose case is being appealed, is one of at least 10 men sentenced to Death Row who had claimed they were tortured into confessing by officers working for former Police Cmdr. Jon Burge.

Cunningham was hoping new hearings in Kitchen’s case would pave the way for a new trial.

A former Cook County public defender and lawyer with the Illinois state appellate defender’s office, Cunningham switched to private practice years ago but continued to focus his career on capital cases.

At a Hyde Park church several weeks ago, Cunningham was applauded for his efforts on Jones’ behalf.

“This is a loss not only to his family, but to the client community and the legal community,” said Marshall Hartman, a top supervisor in the state appellate defender’s office.

And just Wednesday night, Cunningham appeared at the James R. Thompson Center downtown with Jones as part of Gov. George Ryan’s commission on the death penalty, set up after a moratorium was put in place to review the state’s system for capital punishment.

Ex-pastors face 2 years in $1 million embezzlement case

Author

Richard Cunningham, who founded the church in 1971, and his son Philip, who took over as senior pastor in 1995, have two months to decide whether to accept the offer.

The pastors resigned in 2006 after a private investigation found that more than $3 million in funds from the church and an affiliated school had not been accounted for. The scandal nearly destroyed the church, with hundreds of members leaving.

Though the congregation has grown since then under its new pastor, Brian Moore, the church board announced last month that it would be closing Calvary Baptist School at the end of the school year, due to declining enrollment.

Anticipating a conclusion to the case at a June 12 hearing in which victims will read their impact statements, Superior Court Judge James A. Stotler did not set a trial date at a hearing this morning.

Marlin Stapleton, who represented both Cunninghams at the hearing, said that the case was about over, and that his clients were open to taking the plea deal.

“They respect the offer,” Stapleton said.

The fact that the Cunninghams returned some $3 million in cash and property to the church may have won them some leniency, said Deputy District Attorney Doug Brannan.

The judge could still reconsider his sentence, but there would have to be some pretty radical new testimony during the victim impact statements for that to happen, Brannan said.

Asked whether the likely sentence was fair, Brannan said, “The judge is the sentencing authority and I defer to him.”

The charges carry a maximum sentence of six years in state prison.

Steve Rodig, a retired captain from the Anaheim Police Department, opened a private investigation into the case in April 2006 at the church board’s request.

Later, Det. Sandra Stone of the Brea Police Department tallied $3,669,376 that the Cunninghams withdrew from secret accounts as cash or cashier’s checks.

In separate reports, Rodig and Stone say that both Cunninghams confessed to taking smaller amounts. Stone reported that Philip Cunningham admitted taking $700,000 to $800,000 between 1998 and 2006, and that Richard Cunningham admitted taking $400,000 since 2000.

The Cunninghams, who each earned less than $100,000 a year on the books, between them owned six homes, two timeshares and cars that included a Cadillac and a Mercedes-Benz. To pay back the church, Phil Cunningham deeded over a Palm Springs condo and sold his Yorba Linda house. Richard Cunningham deeded his Yorba Linda house to the church and paid several hundred thousand dollars in cash, according to property records and former church board members.

Richard Cunningham’s debt was paid almost entirely through appreciation on his house at 4415 Deodar Dr. He bought the house in 1989 with a $165,000 mortgage, and the church sold it at the peak of the real estate boom for $1.7 million.

After the scandal broke in April 2006, Richard Cunningham deeded a condo at 20024 Clearwater Dr. in Yorba Linda to another son, Richard Cunningham II.

Richard Cunningham OBITUARY

Richard Cunningham May 30, 1949 – July 19, 2015 Resident of San Martin Richard James Cunningham passed peacefully in his sleep at 66 years old – the world lost a truly great man. Known variably as Dick, Rich, Richie, Old Man, Uncle Richard, dad, and most recently grandpa, he was born and raised in San Jose, though he called San Martin home for the past 35 years.

Richard worked as a Gardener for the City of San Jose, retiring 7 years ago. An avid surfer, he loved all things ocean, and still took his board out in search of waves and salty air. A kind, fun-loving man, he was always ready for a party. More so, he loved being the center of the party. He loved animals, a dog person through and through. He loved to make people laugh, and was a terrific and energetic storyteller. He never met a stranger that stayed a stranger for long. Sporting a thick white beard in preparation for the holidays, he looked forward to playing Santa every Christmas for anyone in need of a visit, and especially loved giving out gifts at Betsy’s Restaurant on Christmas Day for over 20 years. A life-long hippie, and classic rocker, anyone who met him knew that he marched to the beat of his own drum, and he certainly lived life to its fullest.

Richard leaves behind his wife Cathy, his daughter Alison (Chris) and new grandson Hayden, and son Andrew (Tricia). He is also survived by his loving siblings Steve (Gayle) and Anita (Mike), nephews Elliot and Tristan, brother-in-laws Jay and Tim, and niece Lexey.

There will be a Celebration of Life Friday August 7, 2015 from 12:00 noon to 3:00 pm at Seascape Beach Resort (Riviera Room) in Aptos. In lieu of flowers, donations can be made in Richard’s name to any local animal charity.
