Exclusive: attorney general schneiderman recovers cash swindled in condo scam pitched by politician.

Thanks to Attorney General Eric Schneiderman (pictured), Corporan said, the state of New York has now forced Diaz to pay restitution.

The commercials tied to the swindle offered a dream home in Pueblo Bávaro, a new, gated, full-service condo community near the Dominican Republic’s Punta Cana resort region — for just $40,000 to $90,000.

They appeared on local Spanish-language TV from 2004 to 2011, and they seemed especially legitimate because the salesman they featured, Danilo Díaz, was not simply the owner and developer of Pueblo Bávaro, he was a top political leader in the Dominican Republic.

Díaz is special assistant to the country’s president, Danilo Medina, and is also head of electoral affairs for the ruling Dominican Liberation Party. Before that, he was chief of immigration in the cabinet of Medina’s predecessor, Leonel Fernández.

Pueblo Bávaro was pitched as a new, gated, full-service condo community near the Dominican Republic's Punta Cana resort region — for just $40,000 to $90,000.

But Pueblo Bávaro quickly turned into a nightmare for Dominican New Yorkers who shelled out from $9,000 to $33,000 in down payments at the Rivas Travel Agency in Washington Heights, a local firm that helped market the condos for Díaz.

Many of those buyers never got the home they were promised. Others waited years for their condo, then received no legal title, or discovered squatters when they tried to move in. As for the advertised amenities, the place was a slum, according to court papers filed by Schneiderman.

No gas service, no garbage collection, no security. Poorly kept roads. Algae in the community pool. Abandoned cars littering the grounds. Some buyers shipped furniture to their new homes only to find it vandalized or stolen.

Pueblo Bávaro quickly turned into a nightmare for Dominican New Yorkers who shelled out from $9,000 to $33,000 in down payments at the Rivas Travel Agency in Washington Heights, a local firm that helped market the condos for Díaz.

Luz Cruzado and her husband Wilfredo Medina gave an $18,000 down payment in September 2004 for a $60,000 unit.

“Within a year and a half, they gave us the apartment unfinished,” Cruzado said. ” They demanded the rest of the money and gave us a sales contract but never gave us title to the property.”

Margarita Corporan, an accountant from New Jersey, attended a meeting in Washington Heights in 2007 where Danilo Díaz promoted his project to about 50 attendees.

Advertisements for the community appeared on local Spanish-language TV from 2004 to 2011.

“He was well-known back home as a government official and he practically assured us the government was backing the project,” Corporan said.

After visiting the development, she and her husband handed Díaz’s company, Consorcio Empresarial Emproy-Divisa, a $26,700 down payment for an $87,000 apartment.

“Two years passed, then three years and nothing happened,” she said. “We kept calling and we couldn’t get any answers. Then they wanted us to pay more money up front for an apartment in a different development. We told them, we want what we paid for.”

Many of those buyers never got the home they were promised. Others waited years for their condo, then received no legal title, or discovered squatters when they tried to move in.

Thanks to Schneiderman, Corporan said, the state of New York has now forced Diaz to pay restitution.

In 2013, Schneiderman sued the Diaz company and David Rivas, the owner of Rivas Travel, for deceptive and fraudulent practices. And this week, Manhattan Supreme Court Justice Joan Kenney approved a consent order.

Under the order, 29 victims have already been repaid up to $33,000 each from Diaz’s company — a total of $540,000 in cash restitution. Another 40 have gotten clear legal titles to their properties. And Diaz has promised to secure 16 remaining titles within 60 days.

Thanks to Attorney General Eric Schneiderman (pictured), Corporan said, the state of New York has now forced Diaz to pay restitution.

Diaz admitted no wrongdoing, but was slapped with a $75,000 penalty and banned from any further real estate sales in New York. Travel agency head Rivas also paid a $25,000 penalty.

“New Yorkers must have confidence when interacting with foreign corporations that do business in this state,” Schneiderman said in a statement. “And those corporations that break laws and then leave the state or country will not escape our reach.”

“Everyone worked hard to accomplish this agreement and it was satisfactory to both sides,” said Boris Kogan, the New York attorney for Díaz’s company.

The Pueblo Bávaro project “suffered as many real estate developments did during the economic collapse in 2008,” Kogan said, so many apartments couldn’t be delivered as scheduled.

Asked why buyers who received apartments didn’t get legal property titles for up to 10 years, Kogan claimed the title process in the Dominican Republic is slow.

It took Schneiderman and a court in New York to secure the justice for these immigrants that the government of their own home country refused to provide.

Private clubs such as Soho House, Zero Bond and Casa Cipriani cemented a long-held Manhattan tradition of the city’s elite clamoring for exclusive spaces. Of course, there will always be the old vanguard — like the Yale Club, Harvard Club and New York Yacht Club — but freshly unwrapped Centurion New York towers over many high-end hideaways from its lavish perch on the 55th floor of the One Vanderbilt building.

The elusive, invitation-only American Express Centurion card (commonly called “the Black Card”) has become a status symbol for the modern day, much like a membership to one of the aforementioned clubs was some years ago. Unlike many of those discreet dens, though, anyone can make a dinner reservation for the Centurion club — no Black Card necessary (but availability is scarce, so you will have to check often).

When Centurion New York made its grand debut in the spring of 2023, it marked a significant shift for American Express in that it was a space that ventured beyond the brand’s ballyhooed airport lounges. The company chose a remarkable venue for the unveiling, too. The One Vanderbilt, a 1,400-foot skyscraper, is the tallest commercial building in Midtown Manhattan. Daniel Boulud’s Forbes Travel Guide Four-Star Le Pavillion resides on the second floor. And SUMMIT, an immersive, four-story observation deck, provides breathtaking vistas from the top three floors.

Getting up to the Centurion club is the first bit of secretive fun you have at the address. You check in with security before swiping your QR code — you’ll get this once you make your difficult-to-come-by dinner reservation on Resy — through the turnstile that directs you to elevators. As you’re whisked up to the 55th floor, the windowless lift heightens anticipation. Once the doors open, all of Manhattan is at your feet — or at least as much as can be captured in the club’s floor-to-ceiling windows.

It’s impossible to underscore the million-dollar view. The club’s positioning affords vistas of all five boroughs. Two Manhattan icons, the Empire State Building and the Chrysler Building, flank the right and left sides of the club, with windows running along the perimeter wall.

Once you finish gasping, get comfortable in the Yabu Pushelberg-designed club’s reception area, The Salon. Members or guests with reservations can relax before or after their meal with drinks, desserts and light bites. The artwork helps facilitate the living-room atmosphere with a collection of iconic New York photographs of famous faces as easily recognizable as any family photo album.

The other half of the space contains ultra-modern art, as if the home’s owner had a change of design heart mid-renovation. A black Rothko-esque painting and black cloth cocktail napkins cleverly call the Black Card to your subconscious. Comfortable modular furniture ensures the space feels cohesive and inviting. You can as easily imagine lingering here over after-dinner drinks or a between-emails Perrier.

After your time at The Salon is over, enter Boulud’s delicious world. Both The Studio and The Gallery’s epicurean experiences are overseen by the iconic chef. The Studio serves a casual but unmistakably elegant ambiance to guests. It’s 100 percent Boulud, but à la carte.

Tempting starters from the most recent spring menu included the pan-fried fairy-tale eggplant served with maple lemon labneh, crispy shallots and scallion oil and a decadent wagyu sirloin tartare done with waffle chips.

Amid The Studio’s black tabletops and the window-side banquette, a sleek, long, silver-topped bar runs along the interior. The cocktails alone are worth the cost of turning your back on the Empire State Building, if only for a little while. For a complete sensory serenade, stop by for live jazz on Fridays.

As you round the corner, a transition to the more formal Gallery can be felt. The Studio’s abstract art gives way to more concrete works. Immaculate white tablecloths draping over the tables further illustrate a change in mood and menu.

But don’t be mistaken; The Gallery is far from fussy. This is an impressive feat, considering how a trio of Ossetra caviar is an optional starter and elaborate dishes such as Argentine red prawns served with a buttermilk, horseradish and pine medley or mint-flavored lamb highlight the five-course tasting menu.

In addition to the Boulud-stamped cuisine, The Gallery cooks up one of the city’s most impressive peeks at the Chrysler Building. When you’re standing at the hallway’s entrance, at the table nearest The Studio, the Chrysler Building almost seems within touching distance, but as you walk closer to the landmark, it actually appears to get farther away. It is a clever optical illusion and a subtle reminder that, even from Manhattan’s top, there will always be something just out of reach.

In this case, if you don’t have a membership, it’s the Centurion club’s other half of the floor that proves just beyond your fingertips. This private portion features a member’s bar, a wine cellar, an event space and an ultra-exclusive pink-hued bar that’s rumored to be reserved for the Centurion club’s top-tier members.

But Black Card holder or not, the dining experience is the same and the staff offers everyone impeccable service. So, even if it takes you a few extra times to secure a reservation because you’re not in American Express’ upper echelon, seek comfort knowing that this club rewards the determined.

It's resulted in at least one senator missing a vote, the postponing of a congressional mark-up, and a bevy of Republican heavyweights turning themselves into attack dogs for the presumptive 2024 nominee — who remains barred from criticizing jurors and witnesses via a gag order.

And Trump has yet to receive a courtroom visit from his own wife , Melania.

Here are all of the Republicans who've flocked to the trial so far.

Sen. Rick Scott was the first elected Republican to show up. He ended up missing a vote.

On Thursday, May 9, Sen. Rick Scott of Florida became the first elected Republican to show up to the trial.

"What he is going through is just despicable," Scott told reporters outside the courtroom, arguing the trial was "clearly criminal" and was being run by "political thugs."

Scott's visit came in the middle of the week, while the Senate was taking votes on a bill to reauthorize the Federal Aviation Administration for the next five years.

The Florida senator, who's up for reelection in November, ended up missing a procedural vote on the bill later that day.

That prompted his Democratic opponent, former Rep. Debbie Mucarsel Powell, to slam him as " sucking up to a defendant found liable for sexual abuse" and putting his "own extreme agenda before the people he was elected to represent."

Sen. JD Vance was the first VP contender to show up.

On Monday, May 13, Sen. JD Vance of Ohio was among the next crop of senators to show up — and the first vice presidential contender to do so.

He later took to social media , calling the courtroom "dingy" while suggesting that the "main goal of the trial is psychological torture."

Sen. Tommy Tuberville

Tuberville came to the trial alongside Vance, where he derided jurors as being "supposedly American."

He later told the conservative network Newsmax that he came to the trial to help Trump "overcome this gag order."

Sen. Eric Schmitt

The Missouri senator, among the first to endorse Trump in 2024, visited the trial on Tuesday, May 21.

Like Sen. Scott, he ended up missing votes to do so.

"You want to talk about threats to democracy? That's what this is across the street," Schmitt said at a press conference with other Republicans outside the trial.

Gov. Doug Burgum was the 2nd VP contender to show up.

Burgum — another VP contender whose political stock has been on the rise recently — attended the trial on Tuesday, May 14.

He and the other Republicans in attendance quickly made waves on social media for wearing apparently matching outfits.

Vivek Ramaswamy showed up, too.

Vivek Ramaswamy, the tech entrepreneur and 2024 presidential candidate, showed up to the trial on the same day as Burgum.

He also happens to be a vice presidential contender — albeit, a lower-tier one .

House Speaker Mike Johnson

The highest-ranking Republican to visit the trial has been House Speaker Mike Johnson, who traveled to Manhattan on the same day as Burgum and Ramaswamy.

The speaker delivered a series of remarks — including slamming the district attorney, the judge, and Michael Cohen — without taking questions afterwards.

"He is soon to be officially the nominee of one of the major parties in our country," Johnson said of Trump. "Running for president, and they have him tied up here in this ridiculous prosecution. That is not about justice, it's all about politics, and everybody can see that."

He concluded by insisting that he came to the trial "on my own" because he's "deeply concerned about this."

Two dozen other House Republicans have also shown up

On Thursday, May 16, the biggest crop of House Republicans yet attended Trump's trial.

That included Rep. Lauren Boebert of Colorado, who was met with chants of "Beetlejuice" as she took to the microphones outside the courtroom.

Iowa Attorney General Brenna Bird and Alabama Attorney General Steve Marshall were among the cohort of Republicans who attended the trial on Monday, May 13. South Carolina Attorney General Alan Wilson attended the trial on Monday, May 20.

Their attendance is particularly striking: they are the top law enforcement officials in their respective states, and they're publicly taking the side of a criminal defendant in another state.
