39 people rescued from stranded duck boat in Lake Austin

AUSTIN, Texas (FOX 7 Austin) - The Austin Fire Department rescued 39 people after a duck boat with Austin Duck Adventures became stranded in Lake Austin. 

According to firefighters, AFD was dispatched to Walsh Landing to assist a stranded duck boat on Lake Austin. A ski boat also assisted towing the boat to shore.

There were no injuries and fire fighters assisted 39 people off the boat.

According to their website, Austin Duck Adventures offers an amphibious tour that includes tours of downtown Austin and beautiful Lake Austin in an Unsinkable, US coast guard inspected, Hydra Terra vehicles. Austin Duck Adventures' scenic tour is around 75 minutes long. 

“These tour vehicles, they do a lot of trips in the summertime, and, sometimes, maintenance issues occur. This time a maintenance issue occurred out on the lake while we had a full boat of people,” said William Duncan, boat captain for Austin Duck Adventures.  

Tourists waited on the water for about 50 minutes in the middle of the day. 

“They were all calm and it started out kind of funny, just like anything else, you get about 30 minutes into it and we're like, ‘Hey man, it's hot,’” Duncan said. 

Austin Duck Adventures said it was engine trouble that left the boat stranded in Lake Austin.

You’re riding in a vehicle with dozens of other people, when it suddenly veers off the road and into a body of water. It sounds alarming, but it’s an experience tourists pay for all the time when they board a “duck tour.”

Duck boats—vehicles that can operate on land and in water—have been operated as tourist attractions in harbor, river, or lake cities in the U.S. since 1946, many using surplus military amphibious landing vehicles from World War II. And while the majority of duck tours go off without a hitch, there have been exceptions with sometimes deadly results.

Since 1999, there have been 12 incidents in the U.S. involving duck boats, resulting in 44 deaths . The most recent of these has also been the deadliest: the July sinking of a duck boat on Table Rock Lake near Branson, Mo., which killed 17 people and injured as many as 11.

Several lawsuits have already been filed against the company that operated the boat, including one for $100 million .

The accident, of course, made international headlines and has raised concerns in other cities, and even calls to ban the attractions. Jim Hall, the former head of the National Transportation Safety Board, compared the vehicles to “unregulated amusement park rides.” Because the vehicles don’t fall completely within the “boat” or “bus” categories, oversight of them has been unclear, according to a USA Today article.

The National Transportation Safety Board, which is investigating the Branson accident, “has complained in the past about a lack of oversight and sometimes conflicting regulations over the vehicles,” says USA Today . Maintenance and condition are also concerns, especially for the World War II-era duck boats.

“Duck boats are death traps both on water and on land,” Andrew Duffy, a Philadelphia lawyer who has represented families in accidents involving the vehicles, told USA Today. “They should be completely outlawed.”

The Missouri accident has some worried about the safety of Austin’s own duck tour attraction, the Austin Duck Adventures. An employee told KVUE-TV recently that there has never been an accident on the water with their boats.

The Austin attraction, which takes riders out onto Lake Austin, uses a different kind of vehicle from the one in the Missouri accident, a newer Hydra-Terra boat, “advertised as unsinkable,” according to KVUE. Hydra-Terra boats have better safety protocols, including larger windows that allow easier escape, the employee said. They are also not permitted to go on the water in bad weather conditions, unlike the Missouri duck boat, which capsized during a thunderstorm. The boats in Austin are also inspected annually by the Parks and Wildlife department.

Riders with safety concerns should make sure, before boarding a duck boat, that it has adequate safety gear, such as floatation devices, and a clear and easy means of escape. And if there’s a thunderstorm, stay on dry land.

5 weird things we learned about Austin during a Duck Adventures tour

AUSTIN (KXAN) — You’ve probably seen the Austin Duck Adventures tours around town. If you’re lucky enough to be standing on the side of the road when one passes, you’ll likely get “quacked at,” meaning the folks on board blow into whistle-like duck bills at you.

The tours also draw eyes when the bus, which doubles as a large pontoon boat, drives right into the lake, where the tour continues.

“I had to get out of the house today because we had some work being done, so I thought it would be fun to go on a duck tour that I never go on,” said Barbara Glaser Fryer, a woman who has lived in Austin since the 80s and was on the tour last week.

Even Glaser Fryer admitted, with her extensive Austin knowledge, there were things she learned on the tour. It’s something Robert “Captain Bob” Ojeda promises will be the case if you decide to give it a whirl.

“You’re out here for 75 minutes and you get to know things that would take you about a week to discover,” he said. “I promise you, you’ll find things out about the city that you didn’t know.”

Here are five things we learned when we hopped on for a ride:

• The Texas State Capitol is taller than the U.S. Capitol building by roughly 15 feet
• There are a lot of famous people that live in Austin and we learned about them. We most notably enjoyed hearing about Sandra Bullock’s waterside living situation
• Austin City Hall is made to look like an armadillo from the side
• The Frost Bank has an owl face on it. There’s a conspiracy theory about how it got there that involves someone getting rejected from the University of Texas and attending Rice University instead, which has an owl as its mascot. Sadly, a quick Google search shows that theory is false
• Austin is known as the live music capital of the world (we know this one), but also the food truck capital of the world and the tattoo capital of the world

Visitors can hike through scenic trails, wade in refreshing swimming holes, and bike along the rugged terrain renowned for its limestone cliffs. Within Zilker Park's 358 acres lies one of the crown jewels of Austin: Barton Springs Pool. The pool itself measures three acres in size, and is fed from underground springs with an average temperature of 68-70 degrees, ideal for year-round swimming.

Alamo Recreation Center offers year-round inclusive Therapeutic Recreation programming for adults and seniors with differing abilities. The park includes a playscape, multi-use field, Gaga pit, and a covered, lighted basketball court.

The Elisabet Ney Museum is the historic home and studio of Elisabet Ney, a wildly iconoclastic German sculptor who moved to Austin in 1882. The museum enthusiastically celebrates her art, her history and her legacy through exhibitions and events for the whole family.

The museum enjoys numerous historic designations and is a cornerstone of the Hyde Park National Register Historic Neighborhood. Admission is free.

The Emma S. Barrientos Mexican American Cultural Center (ESB-MACC) is dedicated to the preservation, creation, presentation, and promotion of the cultural arts of Mexican Americans and Latino cultures.

NOTICE: The ESB-MACC will be closed for its Phase 2 expansion and renovation project starting in January 2023. Programs and events will be held at other sites. Boat Ramp Reopening

Public access to the boat ramps at Lake Walter E. Long reopened at noon on January 25, 2024 as the lake level is now high enough to safely allow boat launching.  Austin Parks and Recreation will continue to monitor available water elevation levels.

The Lamar Senior Activity Center (also called "The Senior Activity Center - Lamar") offers instructed classes, health and wellness programs, educational seminars, workshops, trips, dances, volunteer opportunities, support groups, special events, meeting space and private rental space.

Our Art Gallery features the work of local artists who are 50+ years old. We provide Visitor Center information and have a history exhibit that explores Austin's immigrant history through the Lundberg-Maerki Historical Collection.

Pickfair Community Center hosts a variety of recreational and leisure activities for the far Northwest Austin community, utilizing the old fire department building as a "micro-gym" and an additional room as an activity and meeting space.

The Austin Parks and Recreation Department currently operates two skate parks - one in Mabel Davis District Park and the Heath Eiland and Morgan Moss BMX Skate Park at 1213 Shoal Creek Boulevard next to Austin Recreation Center .

The South Austin Senior Activity Center (SASAC) functions as a special use resource facility for persons 50 years of age and older. 

Southern Walnut Creek Trail is a nature lover’s delight.  Located in East Austin, this beautiful twisting and turning maze of trees and foliage is the city’s newest recreation resource for hikers, joggers and bicyclists.

Walsh Boat Landing is a concrete boat ramp on Lake Austin, operated by the Parks and Recreation Department. Boat launch fee: $10, payable by card/credit at the kiosks located in the parking lot.

Zilker Metropolitan Park, located 2100 Barton Springs Road, is Austin’s oldest metropolitan park. The park is located at the juncture of Barton Creek and Lady Bird Lake and comprises more than 350 acres of publicly owned land.

Austin Duck Boat Owner Says Risk Minimal

Investigators are still working to find out why a duck boat crashed Thursday morning in Seattle, killing four people . You can find duck boat tours in just about any popular tourist city -- and that includes Austin.

The pictures and video show a gash in the side of the charter bus, where it appears the duck boat hit the bus on a bridge in Seattle. Here in Austin, the accident caught the attention of Paul Mahler, who owns Austin Duck Adventures. "As a business owner obviously safety's our main concern and that would be a nightmare," he said.

Mahler is very familiar with the amphibious vehicles used in duck tours around the country, although he owns a different brand than the one involved in the Seattle accident. "Speed probably had an issue in it," he said. "I think I did hear on the news that the vehicles may have been traveling at 55 miles an hour."

Duck boats are big vehicles, built on a bus chassis. In Austin, though, they don't go very fast. "On our tour there's no spot where we travel more than 30 miles an hour," Mahler said. He added that his duck boats are maintained regularly, and his drivers are commercially licensed and have regular safety training.

Duck boat accidents are rare -- one happened earlier this year in Philadelphia, when a Texas woman was killed as she was crossing the street looking at her phone and was hit by one. Before that, the last report of a duck boat KEYE found happened in 2010, also in Philadelphia.

Mahler says his 75 minutes tours through Downtown Austin and into Lake Austin are safe, and will continue running. "I have not heard of any safety issues with amphibious trucks travelling on the road," he said.

Duck Boat Tragedy: Four years since ‘Ride the Ducks’ boat capsized on Table Rock Lake

BRANSON, Mo. (KY3) - Tuesday marks four years since a Ride the Ducks boat on Table Rock Lake capsized during a storm, sinking and killing 17 people on board.

On July 19, 2018, a Stretch Duck 7 duck boat with 31 people on board capsized and sank in stormy weather near Branson, Missouri.

Sixteen passengers, including nine from the same family and one crew member driving the boat, drowned that night, leading to one of the deadliest boating accidents in United States history.

In their initial assessment, authorities blamed thunderstorms and winds that approached hurricane strength. The duck boat sank under high waves while winds around the area reached up to 70 miles per hour that day.

Investigators say Ride the Ducks had plenty of warning about the severe weather, but the boat still launched more than 20 minutes after a thunderstorm warning was issued for Table Rock Lake.

THE LATEST DEVELOPMENTS

Four years later, people are still pushing for answers and working to come to terms with what happened.

On April 7, the Missouri Attorney General and Stone County Prosecutor refiled 63 criminal charges against three employees on duty when tragedy struck. Captain Kenneth Scott McKee and two supervisors, Curtis Lanham and Charles Baltzell, all face a slate of felonies that include at least 17 criminal charges each.

This decision came just two days after Stone County Judge Alan Blankenship dismissed 63 state-based charges initially filed against McKee, Lanham and Baltzell last year. When the charges were dismissed on April 5, Judge Blankenship ruled the unique characteristics of the boat led to it rapidly sinking. He also said the staff was aware of the storm, but there is no evidence they were aware of the storm’s “gust front.”

As part of the latest court proceedings, Captain McKee faces 17 involuntary manslaughter charges and 12 endangering the welfare of a child-death of a child charges. Lanham and Baltzell each face 17 involuntary manslaughter charges.

Missouri Attorney General Eric Schmitt released this statement to KY3 News on the new charges on April 7:

“As I’ve said previously, my office is committed to fighting for justice on behalf of the 17 people that were tragically killed in 2018 - that’s why we refiled the charges in this case.”

Schmitt released this statement last year when his office first filed charges:

“There was a severe weather event already taking place. Based on his training and experience, he should have never gone in the water that day. There were also folks, the GM and the operations officer, who should have known better too, and the consequences here were incredibly tragic.”

Last year, Missouri U.S. Sens. Roy Blunt and Josh Hawley reintroduced federal legislation to improve the safety of duck boats. The bill would require the use of life jackets and equipping all duck boats to be more buoyant during emergency flooding.

“These common-sense safety measures, which are long overdue and need to go into effect immediately, will help prevent an incident like this from ever happening again,” said Sen. Blunt.

The U.S. Senate passed the bill during its latest go-around, but the legislation did not make it through the House.

REMEMBERING THE TRAGEDY

For emergency responders, the scene that unfolded at Table Rock Lake remains vivid in their minds.

“Huge waves coming in, hitting that rock face and just going up that rock face. I’m just like ‘Wow.’ I’m like ‘I can see why a duck boat sank,’” said Mike Moore, Southern Stone County Fire Protection District Deputy Chief.

“It was chaos,” Stone County Sheriff Doug Rader said. “One of the hardest things in the first 20 minutes there was trying to grasp ‘Where [are] all 30 of our people that were on this duck?’ It took a while to understand that they’d drown.”

Fire crews, police officers, paramedics, and state troopers flooded to the docking area of the Showboat Branson Belle, where the Ride the Ducks boat was supposed to get back on land. The boat capsized nearly 150 feet from that location.

“In almost 30 years of law enforcement, that was probably one of the most traumatic events I have been involved in,” said Rader. ” I had a deputy on [the Belle] who jumped in and helped save people and dragged the deceased out of the water. He’ll forever be affected by that. The emotional impact it made on everyone in this area, that tragedy will never be forgotten.”

Tia Coleman and her nephew are among the survivors, but she lost several family members in the accident.

“Keep us in prayer. We’re going to need it,” said Coleman days after the tragedy.

Attorneys for Coleman say she was disappointed when federal charges against the captain and attraction supervisors were dismissed last year, but she has renewed hope that the new charges filed by the state will bring justice for her and all the families impacted by the tragedy.

RESEARCH AND FINDINGS

Duck boats, like the one that capsized near Branson, were originally designed for the military, specifically to transport troops and supplies in World War II. They were later modified for use as sightseeing vehicles for tours that begin on land before going into the water.

In November 2019, the National Transportation Safety Board released a “Safety Recommendation Report” on the accident. The report mentions that the U.S. Coast Guard had repeatedly ignored safety recommendations that could have made tourist duck boats safer and potentially prevented the tragedy.

The report is similar to one issued in 1999 after a deadly accident involving an amphibious vehicle in Hot Springs, Arkansas. Thirteen people were killed in that accident.

According to the report, the NTSB repeatedly urged the Coast Guard to require upgrades for the boats to stay afloat when flooded and to remove barriers to escape, such as canopies. The report found that a fixed canopy and closed side curtain impeded passenger to escape, likely causing more deaths.

“Lives could have been saved, and the Stretch Duck 7 accident could have been prevented had previously issued safety recommendations been implemented,” said NTSB Chairman Robert L. Sumwalt in a November 2019 statement.

The NTSB says it recommended changes to 30 duck boat operators several years ago, but only one has made the recommended improvements.

In April 2020, the NTSB released findings of its investigation into the sinking of the Ride the Ducks vessel. Following the investigation, the Coast Guard agreed that canopies and side curtains should be removed from the duck boats, according to documents.

A lieutenant says the Coast Guard issued guidance in 2000, after an NTSB recommendation, urging inspectors and vessel owners to evaluate canopy design and installation. The guidance also recommended inspections of the design, sets, deck rails, windshields and windows “to ensure the overall arrangement did not restrict the ability of passengers to escape.”

An unrelated internal investigation performed by the National Weather Service found that local meteorologists followed the procedure necessary to ensure public safety on the night the duck boat capsized.

LOOKING BACK AND AHEAD

Robert Mongeluzzi, an attorney for survivor Tia Coleman, hopes the recommendations handed down by the NTSB in 2019 will finally be adopted by the Coast Guard.

“It is rare for one federal agency to really go after another. I was struck by how strongly the NTSB indicated that the Coast Guard just had not done the job they were supposed to do, which is protecting passengers and making safety first,” said Mongeluzzi.

Mongeluzzi says he and Coleman plan to meet with Coast Guard officials in the future to lobby for stricter laws and regulations.

“It was a very frustrating and emotional day for Tia Coleman,” said Mongeluzzi. “Her family would be alive if the duck boat industry had done their job and if the Coast Guard had done their job. Both of them have the blood of 17 victims here and two in Philadelphia on their hands.”

Ripley Entertainment, Inc., the company that operated duck boat rides in Branson, has settled 31 lawsuits filed on behalf of victims of the accident. The final lawsuit was settled for an undisclosed amount in January 2020.

Ride The Ducks, however, has not operated in Branson since the tragedy four years ago.
