Spain has very peculiar cannabis laws and due to a loophole in the constitution marijauan is partially legalized. You are actually allowed to smoke and grow weed at private places, for example, your house, but as soon as you go out the cannabis becomes illegal. Possession of small quantities of weed, meant for your own use, is decriminalized and you can only get a fine. Most people that smoke a joint on the street get away with a warning and weed confiscation, however.

Weed is almost legal in Tenerife, but you should still be careful when smoking in public. If the cop doesn’t like you they might give you a fine and that will for sure ruin your day. Don’t smoke around kids or in businesses and you should be fine. The beach, the mountains, or anywhere that is somewhat secluded are good spots and the cops don’t really care if you smoke some weed there and don’t cause trouble. Tenerife has a lot of good smoking spots, so don’t annoy the locals.

Where to get weed in Tenerife

Tenerife is very touristy and some of the people involved in that industry also sell weed. If you walk around the beach and the more popular parts of town you will likely be approached by a dealer. If that doesn’t happen, just ask the guys selling sunglasses, club promoters or any young Spaniard really. Marijuana is very popular among the locals and most of them will be happy to help you. The price is around 5-10 euros per gram, with hash being cheaper. It depends a lot on the dealer and on your abailites to negotiate. The hash is usually better than the weed as it is straight from Morocco.

Hey! Don’t every try to buy from guys selling sunglasses or other guys that sells on the street. Who wrote this? Tenerife is sweet place for clubs, with great atmosphere and very good stuff. Pick a nice one and go there! Prices are lower, quality is better and you will make new friends 🙂

Hii… Seasonal work in a cannabis club is almost impossible, you must be a very trusted person either family or friend, friend meaning you must be a regular visitor to the club so the staff get to know you, and after some time then maybe it´s possible.

Cannabis in Tenerife – The Legalities

Is Cannabis in Tenerife legal? Cannabis for Residents? Cannabis for Tourists? Who is Cannabis for in Tenerife? We get asked all these questions and more everyday from tourists and residents, the information is limited and varies in authenticity, the various laws that apply can be confusing. As an avid cannabis user and a resident in Tenerife born and raised, let me help you to understand the complicated system we have and answer these much asked questions.

Is cannabis legal in Tenerife?

In short, the answer is no… and yes, Cannabis has been de-criminalised in Spain but is not fully legal yet. Possessing cannabis in public is illegal. Possessing cannabis in private is totally legal. The legal age limit is 18+. Transporting cannabis is illegal. It is legal to grow up to 2 plants per person in private – so at your home, at your families home, your friends home. However, any kind of commercial activity relating to cannabis is forbidden and against the law. It´s illegal to buy, sell, trade, or promote cannabis in Tenerife. Growing and distributing to your friends and family for personal use for free is perfectly legal. If a friend does not consume cannabis and you offer to give him some to try, is called “promoting” cannabis which is against the law. Those are the basics, let´s dig deeper…

Cannabis Laws in Tenerife…

are the same as the cannabis laws in Spain. It is as simple as above, not in public, it´s ok in private, no transporting, no promoting. But what does that mean really? Let´s break all that down.

Is it legal to Possess Cannabis in Public in Tenerife?

It is NOT legal to possess cannabis in public, not in your pocket, not in your shoe, not in your under-ware (just because they can´t search there) and not in your bag, nowhere.

If you are found with 5 grams or less of cannabis in your possession, and you are in a public space, the police will do 1 of 2 things. A photo of your passport and a few questions will be taken, and you will be let off with a warning and they will keep your weed, no paperwork will be given. Or the police will give a fine of 200 or 300 euros, they may want you to pay it now if you are a tourist, they may escort you to the cash machine, paperwork will be given, it´s official. However, de-criminalised means it will not be recorded, meaning it will not go on your criminal record.

In Tenerife the legal limit of cannabis considered as a “personal amount” is 5 grams. If you are found with more than 5 grams you may be suspected of supplying or dealing cannabis. Again 1 of 2 things will happen, either you will get a fine of 300 up to 1200€ if the police believe that it´s for personal use. If the police do not believe that it´s for personal use, then you will be off to the police station, charged, fingerprinted, stay at least one night, maybe 2 if it´s the weekend, the police cannot give bail, so you must be presented to the courthouse at the first opportunity. Straight away you have to plead, guilty or not guilty. Not guilty depending on your record and history you may be bailed to appear at another date, and a guilty plea will definitely result in being remanded in prison, and sentenced a few weeks later.

If you are a tourist the courts can face-pace the proceedings, can be done in 1 week, zip zap zop.

Is Cannabis legal in Private in Tenerife?

Cannabis is totally legal in private. Only in the privacy of your home is it permitted to have cannabis in your possession. However, there is one small catch to this, if your cannabis smoke is affecting your neighbours way of life then you´ll be asked to stop, and if after a few warnings you do not stop, the police can charge you with an offence relating to the “public health,” act… and this will create and be recorded on your criminal record. First offence you´ll receive a fine 300€ roughly.

However, your home does not have to be the only “private place” available to consume cannabis legally in Tenerife. If you rent a shop for instance, but take the signs down and black out the windows, the shop is now private and not open to the public, you and your friends can go in there and consume. Again… make sure it doesn´t affect your neighbours, windows closed, blacked out, install extraction and filter unit to filter the smoke before it exits the building, clean smoke, no smell exiting the shop, happy neighbours. If you have no complaints, no one will bother you. If you do have complaints and the police do turn up and you have your friends round, you will have to prove that you are all friends and the club is not open to the public, and do a better job with the extraction filter unit.

This is how  cannabis clubs / cannabis associations  were created. As early as the 80´s people in the  Basque region  of Spain have been gathering daily in these such places. Private, friends and family only, and under invitation only. The door was closed to the public and unanswered.

An important number of “cannabis associations” appeared in Spain from the year 2000, mostly in the Basque country and Catalonia regions, Barcelona is in Catalonia, and in 2010, and again in 2018, statues were passes for the regulation of cannabis CSC´s in Catalonia, meaning the council inspected your premises and could close them accordingly if the conditions were not met.

Is it Legal to Transport Cannabis in Tenerife?

…by foot or by car, from my house to my friends house, from the cannabis club to my house… It is not legal in public, meaning it is forbidden to take it anywhere… from here to there, NO.

It is illegal to transport cannabis in any way, not by foot or by vehicle. In Tenerife this is considered as “drug trafficking” and can be a very serious offence punishable by prison. If you grow your own cannabis and are thinking of popping over to Auntie Sallies to gift her an oz or 2, DO NOT do it, this is drug trafficking. As nice as it is to gift weed, gift a seed instead.

Promoting Cannabis in Tenerife – What does it mean?

Promoting Cannabis in Spain is illegal. What does that mean? Well, normally you would think it´s running promo´s and advertising and marketing ect. Well yes, true, all those are illegal and just as important.

But… Promoting Cannabis in Spain also means talking to someone about it in a way that would encourage them to consume cannabis. Basically encouraging a non cannabis consumer to start consuming cannabis for the first time, is considered as “promoting cannabis”. The only laws on cannabis consumption in Spain are: 1/ You must be over 18. 2/ You must be a regular consumer. If you are not an habitual consumer then the association / cannabis club, must reject your application.

What are the actual Laws regarding Cannabis in Tenerife?

In Tenerife and in Spain they have not made cannabis legal yet. They just leave us to operate in our “grey area” protected by the Spanish Constitution, so at the moment there is no official legislation for cannabis in Tenerife.

Only the 2 simple laws mentioned above. You must be over 18, and you must be a regular consumer. These are the only 2 official laws regarding cannabis consumption, all the other rules were made up by the associations themselves in the late 90´s, and are designed around the “privacy laws” that protect the Spanish people written in the Spanish Constitution.

Can Tourists go to Cannabis Clubs in Tenerife?

The truth? …Yes, however it is frowned upon and has led to problems, big fines and even closures of cannabis clubs. The Police don´t mind really, but the truth is, cannabis clubs legislation was designed around the Spanish constitution that protects the residents privacy. It goes a little something like this… you can do pretty much whatever you want in your own privacy, prostitution is still legal in Spain and operates the same way, in private. Almost anything you do in the privacy of your own home is totally legal, as long as it does not affect your neighbours way of life.

However… tourists of course are not covered by the Spanish Constitution, only people with official residency in Spain are covered by the Constitution, so really and truly cannabis clubs in Spain are for residents according to the cannabis clubs themselves. Luckily, as we mentioned earlier the legislation regarding the regulation of cannabis clubs was made and drafted up by the cannabis clubs/associations themselves, there is no official government law… In the past 5 years tourists are welcome in Tenerife as Spain looks closer to full legalisation soon.

EU discrimination laws also protect the tourists and foreigners in Spain. I must also point out that not one single tourist has ever been charged or even arrested for entering a cannabis club.

WHAT IS A SMOKERS CLUB?

Cannabis Social Clubs are allowed to grow and give cannabis products to its members. The clubs are run through membership fees and donations by its members. In terms of product selection and quality, each club is different. Some have a large selection of marijuana strains, hashish, edibles, extracts and oils available to its members, while others may have fewer options available.

Some clubs have large entertainment areas with pool tables, ping pong and games areas host exclusive music events or educational gatherings for its members. Sometimes you'll find a small bar that serves coffee, water, and other beverages, as well as snacks.

What makes a social club so special is the atmosphere. Because it's membership based, there is a familiar, laid back atmosphere where it's easy to socialise.

To join a CSC in Tenerife you have to be over the age of 18. You should join with a recommendation from another member and no cannabis can leave the premises. You have to be a regular user of cannabis for therapeutic, medicinal or recreational purposes.

So what is a Cannabis Club?

A Cannabis Club is a private, members-only organization where a limited amount of cannabis can be provided to members on the premises. It is, essentially, a Social Club, where people can enjoy using marijuana together in the safety of a legal location. You can consider it a lot like the coffeeshops in Amsterdam. Sometimes food is served there, too, so members can satisfy the munchies.

German man arrested in Russia for allegedly smuggling cannabis gummies

A Moscow court on Wednesday remanded a German citizen into custody after his arrest over possession of cannabis gummies and accusations of smuggling drugs, Russian state news agency Tass said.

Patrick Schobel, 38, was detained at Pulkovo airport in St. Petersburg late last month and will remain in custody until at least March 15, Tass said.

Russia’s Federal Customs Service said the German national arrived in the country to visit a friend, and when searched, a packet of “Fink Green Goldbears” with six cannabis gummies inside was found on him.

According to the Federal Customs Service, Schobel told authorities he brought 10 gummies from Germany into Russia to have a more “restful sleep” on long flights. When the gummies were tested at the airport, they were found to contain tetrahydrocannabinol, which is banned in Russia.

The customs service posted a picture of the gummies, a German passport and the packet with a cannabis leaf on the front. Both Tass and the Customs Service said Schobel faces up to seven years in prison for smuggling drugs.

In Berlin, German Foreign Ministry spokesperson Christian Wagner confirmed that a German national had been arrested. He said Russian authorities informed the German consulate and German officials are in contact with the man’s lawyers.

The report came after President Vladimir Putin recently indicated that he would discuss swapping a Russian jailed for murder in Germany in a wider prisoner swap with Evan Gershkovich , a U.S. Wall Street Journal reporter who was arrested on espionage charges while on a business trip to Russia in March last year.

Russia has previously been accused of targeting foreign citizens to use them as bargaining chips to secure the release of Russian prisoners abroad. The Russian governmnet has denied the accusations.

In a recent interview, Putin appeared to suggest that in exchange for Gershkovich, Russia is seeking the return of Vadim Krasikov who is serving a life sentence in Germany after being convicted of the 2019 killing of Zelimkhan “Tornike” Khangoshvili, a 40-year-old Georgian citizen of Chechen ethnicity.

Prisoner swaps between three countries are rare. In the interview, Putin said Russia is “ready to solve it but there are certain conditions that are being discussed between special services. I believe an agreement can be reached.”

Asked last week whether there had been any effort by Russia to secure a swap of Krasikov and Gershkovich and whether Berlin was in contact with the U.S., the German government refused to comment.

German judges said Krasikov acted on the orders of Russian authorities, who gave him a false identity, a passport and resources to carry out Khangoshvili’s killing.

In addition to Gershkovich, the United States is also seeking the return of Paul Whelan, a former Marine held in Russia for more than four years. U.S. officials were not able to secure his release in December 2022, when they agreed to a deal to swap U.S. basketball player Brittney Griner for notorious Russian arms dealer Viktor Bout.
