Texas Red Dirt icons the Josh Abbott Band have announced a tour for 2024 and their brand new single, “What Were You Thinking” will be available this Friday, October 20th.

The Josh Abbott Band has historically been one of the biggest groups in the Texas country music scene. With collaborations alongside Carly Pearce and Kacey Musgraves , they’ve garnered some mainstream attention over the years. However, their core fanbase in the Texas/Oklahoma region would call them some of the greatest ever to do it. Frontman Josh Abbott also formed a supergroup, The Panhandlers, with Celto Cordero of Flatland Cavalry, John Baumann, and William Clark Green.

The latest album from Josh Abbott Band, Somewhere Down The Road was born from the kind of musical passion that only gets stronger as time goes by. After 15 years of building a wildly devoted following in their home state and well beyond, the Texas-bred now eight-piece approached their seventh studio LP with a renewed dedication to trusting their instincts and speaking an unvarnished truth about life, love, and human nature. Matching their intricate arrangements and immediately catchy melodies with all the raw vitality of a freewheeling bar band, Somewhere Down The Road ultimately captures an essential act at the height of its powers—and fully arms Josh Abbott Band as a formidable force in modern country music.As singer/songwriter Josh Abbott reveals, the unbridled authenticity of Somewhere Down The Road emerged from a deliberate shift in his writing process. Abbott solo-wrote four of the tracks, and co-wrote another four. “For a long time I wanted to write hooky three-minute songs that would sound good on the radio, but now I’m writing from the heart more than I ever have,” says Abbott, whose legacy in Texas music also includes co-founding the widely beloved supergroup The Panhandlers. In fact, the band scrapped an entire album before starting from scratch and creating a body of work that truly fullled their vision—one that echoes Abbott’s deepened devotion to crafting lyrics with a profound emotional realism, often exploring the more complex aspects of family life, love, and the music business. “The more I listened to that other record, the more it felt like a sequel to the last album rather than a reection of where we’re at now,” says Abbott. “This new record came from getting back to who I really am as a songwriter, and there was a lot of exorcising some of the demons from my past.”Not only an evolution of Abbott’s songwriting, Somewhere Down The Road takes Josh Abbott Band in a new and adventurous sonic direction. Produced by Dwight A. Baker (who also produced 2015’s critically acclaimed Front Row Seat) and recorded at his Matchbox Studios in Austin, the album marks the rst eort from the band’s newly recongured lineup, including longtime members Austin Davis (banjo), Eddie Villanueva (drums), David Fralin (keys), and Jimmy Hartman (bass) as well as recent additions Adam Hill (ddle) and guitarists Cale Richardson and Kris Farrow. Along with channeling the electrifying energy JAB’s always brought to the stage since starting in Lubbock in 2006, Somewhere Down The Road encompasses plenty of otherworldly textures, achieved in part through their addition and graceful use of synth. “We mixed this record to be listened to through headphones, so that you can pick up on a lot of elements you might not notice otherwise,” says Abbott. “Dwight and I spent so much time focusing on those little moments for people who want to listen closely.”“In a way we sequenced this record the exact opposite of how we’d usually do it,” Abbott says. “Instead of starting with the upbeat, lighthearted songs, we opened with some of the more experimental tracks, then moved into the ballads, and ended the album with the usually upbeat burners that typically would start an album of ours. This feels like a whole new chapter for our band, so it made sense to present it in a completely dierent way.”One of Abbott’s most personal oerings to date, Somewhere Down The Road embodies an unguarded honesty on tracks like “What Were You Thinkin’” (a bittersweet but uptempo love song on which Abbott confesses to his deepest insecurities and self-doubts) and “She’ll Always Be” (a sweetly poetic serenade to someone eternally free-spirited, dedicated to Abbott’s six-year-old daughter; complete with that ddle accompaniment they’ve always utilized in melodies). Meanwhile, on the stripped-back but spellbinding “Guilt Of A Man,” Abbott delves into a highly delicate matter seldom addressed in song form. “I wrote that about watching my wife go through postpartum depression after the birth of our daughter,” Abbott explains. “I was thinking about all the ways that motherhood aects a woman and how there’s so much struggle involved, and about how I had this intense sense of guilt that only came from wanting to love her. We recorded it live in one take, which felt right for a song that’s so sparse and vulnerable.”Co-written by Abbott and Grammy-winning heavy-hitter Jon Randall (Miranda Lambert, Parker McCollum, Dierks Bentley), the title track to Somewhere Down The Road serves as the album’s centerpiece and an overall mission statement for Josh and the band. “I wanted to write about gaining some clarity in the music industry and how it all works,” says Abbott. “Every night on tour I’m on up there onstage—sometimes that stage is shiny and new, sometimes it’s old and beat-up, but either way I’m singing about my life and everything I’ve been through. I feel like I’m nally starting to see things for what they are: both the fake-ness and the authentic friendships. I’m just happy for us to keep going down this highway together.” Graced with a scorching duo-guitar solo from both Farrow & Richardson, the result is a gritty and glorious look at meeting life on its own terms (“I’m starting to see the forest for the trees/In these made-in-China truckstop shades, it’s looking good to me/Heads or tails, ipping a dime/Betting on FDR to get it right half of the time”).On the more euphoric back half of Somewhere Down The Road, Josh Abbott Band delivers everything from the lovestruck wonder of “Closer To You” (an impossibly catchy expression of longing) to the fun-loving swagger of “Barstool Boys” (a harmonica-fueled anthem courtesy of Fralin for “all your buddies you drink and watch the game with,” as Abbott puts it). Both of those, as well as “Astronaut” and “Brutus, Judas, & You” are co-writes involving longtime friend and hit songwriter Erik Dylan (Luke Combs, Riley Green, Warren Zeiders).On “Back To Normal,” Abbott brings his lived-in storytelling to a piano-laced and brightly swinging meditation on the frenetic pace of modern life. “Back in 2020 when we were all sitting at home, I was thinking a lot about how we’ve let life get so chaotic,” he says. “When I sing that line ‘I’m getting’ back to normal again,’ it’s not about wishing Covid would end and we could go back to being busy again. It’s about slowing down and staying home with our families, and how that’s maybe the normal way to live.” Finally, the album closes with a fast-paced almost punk-country scorching send o to someone who used to be close, (“Caesar had Brutus, Jesus had Judas, and I had you.”)All throughout Somewhere Down The Road, Josh Abbott Band show an uncompromising commitment to moving forward and constantly pushing into new musical terrain, mining inspiration from such eclectic sources as the folkier edges of Americana and Texas Red Dirt country as well as subtly inventive indie-rock acts like Death Cab for Cutie. “I’ve never wanted to make a career out of playing the same songs over and over; I’ve always aspired to be the guy who keeps going as he gets older and continually gives people something new they can look forward to,” says Abbott. “To me this album feels like a real turning point toward that, and I’m optimistic and ready to see where we end up going next.”

The band was formed in 2006 in Lubbock, Texas by Josh Abbott, Austin Davis, Neel Huey, and Andrew Hurt. All members were students at Texas Tech University at the time. The band’s first studio album, “Scapegoat”, was released in 2008. Preston Wait and Eddie Villanueva replaced Huey and Hurt after their departure from the band.

The band’s second album, “She’s Like Texas”, was released in 2010. The album entered the Top Country Albums chart. The lead single from the album, “Oh, Tonight”, peaked at number 44 on the Country Songs chart.

The band’s third album, “Small Town Family Dream”, was released in 2012. The album debuted at number five on the Billboard Country Albums chart. The lead single from the album, “Touch”.

In 2015, the band released their fourth studio album, “Front Row Seat”. The album debuted at No. 9 on the Billboard Country Albums chart. The album’s lead single, “Hangin’ Around”, peaked at No. 47 on the Country Airplay chart. The album’s second single, “Wasn’t That Drunk”, featuring Carly Pearce, peaked at No. 37 on the Country Airplay chart.

In 2017, the band released their fifth studio album, “Until My Voice Goes Out”. The album debuted at No. 22 on the Billboard Country Albums chart and reached No. 141 Billboard 200. During the early hours of October 1, 2017, while the band was performing at the Route 91 Harvest festival on the Las Vegas Strip, a mass shooting occurred. The band canceled their scheduled shows for the remainder of the year. The Highway Kind, the band’s sixth studio album, was released in 2020.

ABOUT JOSH ABBOTT BAND:

Let the good times roll.

When fans of Texas-bred Josh Abbott Band hear the four-track EP Catching Fire, they’re likely to reconnect with a sound from the not-so-distant past. They’re songs of positivity, built on solid country textures and unified by Abbott’s congenial-but-experienced voice.

The seven-piece group cut its teeth as a hard-touring act with hooky melodies that deliver real-world stories. Led by the true-to-life cycles in Abbott’s life, JAB explored new territory with its last two albums – documenting the dissolution of a marriage in Front Row and adding strings and a horn section to Until My Voice Goes Out – but Catching Fire captures a sense of personal renewal.

“My embers are startin’ to glow again,” Abbott sings in the opening line of the title track. Indeed, the entire Catching Fire project is bright, spry, and optimistic. From the limber lines of Preston Wait’s fiddle to the decisive crack of Edward Villanueva’s snare and the animated scratch of Abbott’s acoustic guitar, there’s relaxed energy to the project, a sense of hard-won spirit that can only be developed by confronting – and conquering – emotional hurdles.

“We have a whole new refocused attitude on what we’re gonna do now moving forward,” Abbott says. “Catching Fire is a reflection of what’s happened over the last year and a half of my life.”

“Surprise Surprise” – a jaunty, driving bit of autobiography – details the rise and fall and rise again, namechecking banjo player Austin Davis in the opening line as it follows JAB’s 2006 inception and ascent to one of country music’s most dynamic live acts. Likewise, verse two loosely documents Abbott’s own relationship travails, from love to broken heart to a marriage that resulted in his first child.

While Catching Fire captures the band’s current heartbeat, the songs fit so neatly into the JAB live set that fans experienced them as if they were already part of the band’s canon.

“Half the time, I don’t even introduce them as new songs,” Abbott notes. “We just roll in and play them and watch the fans just bounce around and jam and have fun. Sometimes you’ll see fans look around like, ‘Do you know this song?’ But by the end of the song, they’re singing it.”

Country fans have been singing JAB songs for more than a decade already. The band got its start when Abbott and Davis, frat brothers at Lubbock’s Texas Tech University, braved the stage on open-mic nights at Blue Light Live. Davis managed to make the bluegrass-based banjo fit in a contemporary country setting, establishing a blueprint as additional members joined JAB. Villanueva brought a rock-band spirit on drums and Wait hardened the group’s country stance with his flagship fiddle when they signed on 18 months later. Lead guitarist Caleb Keeter joined in 2010, amping up the group’s power quotient, while keyboard player David Fralin took his place in 2015, bringing an additional layer of texture. The newest member – bass player Jimmy Hartman – added his name to the lineup in 2018, solidifying JAB’s signature tough undercurrent.

The band’s relentless on-stage attitude quickly made it a successful touring act, building out from a Texas band to a regional act to a national crew with a devoted following from coast to coast.

Concurrently, JAB developed its own label, Pretty Damn Tough Records, before that was an accepted practice in country circles. Two of their projects, Small Town Family Dream and Front Row Seat, scored top 10 debuts on the Billboard country albums chart, while five titles cracked the Billboard country singles lists, including a pair – “Oh, Tonight” with Kacey Musgraves; and “Wasn’t That Drunk,” with Carly Pearce – that represented the first chart appearance for current female country stars.

All that music established JAB as a band of renown: a good-timin’ cast with a plethora of sing-along songs that raised concert-goers’ spirits whether your date was a fellow college student or a series of longnecks from the bar.

“When you’re a young band, you wouldn’t know this, but those first couple albums you put out, that is who you are,” Abbott notes. “That is your sound.”

As any reasonable rebel does, the band tested its parameters once it was on solid footing. They signed for a short time with a major label, experimenting by mixing their raw tone with a more commercial edge. As they returned to indie status, Abbott ambitiously documented his first marriage in Front Row Seat. And the expansive Until My Voice Goes Out, recorded as Abbott tended to an ailing father, mixed elegant strings and a Memphis-tipped horn sound. His dad passed away just weeks before they finished the album, and it created a rite of passage that was particularly difficult to process in such a public occupation.

“There were nights in that first year after my dad died, I was bawling five minutes before we went on stage, and I’d have to wipe the tears away and throw on a smile and sing ‘My Texas,’” Abbott recalls. “A good time is what they come for, and I didn’t want to rob them of their experience because of a hardship that I’m going through in my life. I could mourn my father when I was in the back of the bus. The time for it wasn’t when I was on stage.”

Those concerts, in fact, planted some of the first seeds of renewal in Abbott’s life.

“When you’re able to have fun with a crowd of people and sing and dance around on stage, it’s definitely therapeutic,” he says.

As he put the pieces back together and felt a personal sense of renewal, the band as a whole felt a need to get back to its own roots. They took the four new songs – the Abbott/Wait compositions and the two outside pieces – and teamed with accomplished producer Marshall Altman (Marc Broussard, Frankie Ballard, Aaron Watson) for sessions at the Sonic Ranch on the outskirts of El Paso.

The multi-studio facility, nestled in a working pecan orchard, is appointed with bright tapestries and cozy casitas – residences that provide uncanny flexibility. Billy Gibbons, Third Eye Blind, Midland, and Portugal. The Man are among the acts who’ve found inspiration at the Ranch. JAB typically recorded into the wee hours of the morning, hitting their creative stride around the hours when their biological clocks reach their live-performance peak.

“Generally when you record in the studio, you’re working daytime hours,” Abbott says. “But out here in this place, it’s your studio basically; you can do what you want. There were nights that we were recording till 2 or 3 a.m., and then the next day we just wouldn’t start until noon. That’s musician time. We’re so wired to really get our brains going at 10 p.m.”

The band’s musical renewal is perhaps timely. Kacey Musgraves, Maren Morris, Aaron Watson, Midland, and Cody Johnson are successfully blending the Texas mindset – a country framework with unique, multi-genre flavors – into commercial country music, and the JAB tradition fits neatly into that trend.

“If you didn’t know any better, you would have thought Jon Pardi or Luke Combs could have been from Texas,” Abbott says. “I just look at what’s going on in music – not only with the Texas people but with some of the others that are succeeding from other states – and I just hear similarities.”

Catching Fire brings a sense of similarity back to JAB’s own foundation. It’s a return to the band’s sonic past, a revival of its bar-bred optimism and fiery individualism. And it’s a reflection of the group’s off-stage cycles as old chapters are closed and a renewed, upbeat storyline comes to life.

“It’s not about being sad, it’s not about losing a father or going through a divorce,” Abbott says, elaborating on its current emotional position. “We have a great career, we have a great fan base, we’re still making music for a living. I have a beautiful wife and little daughter that brings me to join every day. So there’s a whole lot of personal renewal, and Catching Fire represents all of that. There’s nothing slow, nothing sad.”

Josh Abbott Band on Indie Success: ‘My Best Day Would Be the Worst Day Ever for Luke Combs’

Earlier this summer, when Josh Abbott learned he achieved a third gold single, his first thought was about the big-picture symbolism.

“To have it happen in the second decade of my career, makes me feel validated,” Abbott says. “It says that we are a band that will last and be around a long time. It says that I can write successful music, and that I don’t need to rely on national radio to get it to gold.”

The Josh Abbott band announced on Thursday that “Settle Me Down,” off the group’s 2020 album of the same name, received the certification from RIAA. The song joins Abbott’s 2010 recordings “She’s Like Texas” and “Oh, Tonight” — the latter recorded as a duet with Kacey Musgraves — in hitting the milestone of 500,000 sales.

“‘Settle Me Down’ is a song that I wrote about my wife,” Abbott tells Rolling Stone , “with a couple of buddies of mine who happen to be from Texas. To get to record that song at a later stage is special, and it went gold faster. Those first two took more than 10 years. ‘Settle Me Down’ came out at the end of 2020, and it essentially qualified for gold at the end of 2023.”

Abbott is acknowledging the milestone by releasing “Settle Me Down” as part his “Hangar Sessions” project — a YouTube-based collection of recent songs, recorded full-band, at an airplane hangar in Austin.

In that context, what motivates you now, especially as a songwriter? My family. I find it really challenging to write songs that are sad. I can’t write a breakup song. I’ve already done that in my past. I’ve had a whole album that was about that sort of thing. I’m in a spot now, where it’s hard for me to write those songs, and be balanced as a songwriter. But I’m also not at a stage in my career where I’m writing beer-drinking college songs. I’m writing songs that inspire me about real things. Thankfully, the Panhandlers have been a good outlet for songs like that.

There’s also not a ton of pressure on me to write a lot of songs for myself. We’re seven albums in. The fans know what they like. They want to hear the old shit. I’ve heard Paul McCartney make that joke at a concert. I’ve heard Garth Brooks make that joke. I’ve heard Bruce Springsteen make it. We get it. You want to hear the old shit. But we still want to make new music, and we just have to accept that the new shit might not be smelled as much as the old shit.

Is there a takeaway from reaching gold-level sales while staying independent? I think it’s inspiring for younger artists to be able to see that you don’t have to sign a label deal, and you don’t have to put a song out to national radio, or sell a million records, for a song to be credentialed with an award like this.

Josh Abbott Band Earns Third Gold Single With “Settle Me Down”

The Josh Abbott Band is earning another RIAA certification.

Any RIAA certification is a significant milestone for an artist, and when an artist secures more than one of these certifications, it’s worthy of a major celebration. Especially when you’re an independent artists without the mainstream music machine behind you.

Today, the Texas band secured their third RIAA gold single. For a single to go gold, it must have 500,000 units sold in the U.S., and higher certifications are eligible for rewards should singles or albums significantly surpass that number.

Josh Abbott has already been honored with two gold singles, “She’s Like Texas” and “Oh, Tonight,” featuring Kacey Musgraves; this third award comes with great honor. The third single tagged with this certification comes from their 2020 album, The Highway Kind.

“Settle Me Down” was a quick standout on the album, with fans racking up the streams, now with over 95 million on Spotify alone. The tender love song highlights the relationship of a woman who can calm and keep her partner grounded and his thankfulness to have a love like that.

Abbott reflected on this milestone, noting his gratitude for their fans who continually support their music.

“This is our third gold single, yet this one means even more! To have this success 12 to 15 years into our journey is a true testament to maturing as a writer/artist/musician, building relationships with fans, touring, and utilizing streaming as an asset. I co-wrote this song along with friends of mine (Ryan Beaver and Josh Jenkins) that I’ve known since I first started my career.

I wrote it with my wife and my faith as inspiration. I’m proud of my bandmates on this album as well as our producer and engineer and the magic we created that session out at Sonic Ranch in West Texas. Also honored to have Catie Offerman singing harmonies. It’s simply a phenomenal song that resonates with people and to have this success a decade and a half into touring as a band, it just truly means more.”

As artists are often their harshest critics, it’s incredible to see Abbott still hold love for this song four years later and with releasing another record since. He is not wrong, though; the song is phenomenal and resonates with so many who have that calming presence in their life, whether it be a person or a higher being.

In celebration of the single’s milestone, Josh Abbott has also released an acoustic cut of the song as a part of their Hangar Sessions . This session hammers down the song’s meaning once more, highlighting it in the stripped-back light.

State of Texas: Scrutiny into voter rolls brings concern of chilling effect

A USTIN (Nexstar) — Texas has removed 1.1 million people from voter rolls since 2021, Gov. Greg Abbott’s office announced Monday, highlighting efforts to clean up election data and ensure legal registration.

That includes 6,500 potential noncitizens and more than 457,000 deceased people, according to data the governor’s office provided. But the largest number of canceled registrations, more than 463,000, came from people on the state’s voter suspense list.

When Nico Ramsey went to check his voter record last week, he said he surprisingly found himself among the 2.2 million Texans whose registration status is currently listed as “suspense.”

What this means, according to the Texas Secretary of State’s Office , is that their counties do not know their address or think they moved, which often happens because either a voter registration card or a jury summons sent in the mail is returned as undeliverable.

“I was confused when I saw ‘suspense’ on my status,” Ramsey said Tuesday. “One, it’s not that descriptive on what that means, and it’s kind of intimidating, in a way, to see. Will I still be able to vote? Did I miss out on something? And also knowing that any time I move, I’m always filling out that change of address, and that has always in the past sufficed for switching over my voter information.”

He said he has now submitted another change-of-address form to resolve this issue, though what’s strange is that the information listed on the state’s voting portal includes his current address and zip code. Plus, he voted in the most recent round of elections this spring with no issues. He also posted about his situation on Instagram so that his circle of friends and followers could check on the accuracy of their information.

“I believe my network felt the same amount of shock because they know my voting habits. I’m a very loud, active, proud voter,” Ramsey said. “However, what that did was it sparked someone to go look at their own voter status because if it can happen to me, an active voter, it could happen to someone who might vote not so often, and that’s actually an easier way to fall into a non-active status.”

More than 12% of the state’s almost 18.3 million registered voters are currently part of that suspense list. People can review whether they’re part of it by entering their information into this state portal to check their voter registration status or by contacting their county’s voter registrar .

If they’re seeking to be removed from the suspense list, voters can update their address online by Oct. 7, which is the deadline to register to vote in time for the November general election.

To use that online service, people will need to share their current driver’s license or ID card, their Social Security number or their voter registration card’s voter unique identifier (VUID) number.

“If you are on suspense, you can still vote,” said Joyce LeBombard, president of the League of Women Voters of Texas, noting that people on the list will have to go through a few additional steps before casting a ballot.

Voters will have to complete a Statement of Residence form either when they vote by mail or at their polling location prior to voting. If they moved to a new county, they’ll have to a complete a Limited Ballot application during early voting at the main early voting polling place.

A voter on suspense who moved within the same county, though, would be allowed to vote on Election Day by returning to the precinct in which they previously lived and completing a Statement of Residence at that time.

According to the Travis County Tax Office , it will send two letters through the U.S. Postal Service when it attempts to reach voters at risk of removal from the voter roll. Voters who fail to respond go to a “suspense” file. Voting will move them back to the active voters list. However, state law requires the county to remove the names of those either not voting or who fail to contact the county after four years in that suspense status.

“I think suspense can sound like a scary word, and it’s not. Actually, the suspense list is a way to protect voters because you may have accidentally ended up on this list even though you haven’t moved,” said Alicia Pierce, a spokesperson for the Texas Secretary of State’s Office. “The suspense list guarantees that you’ll continue to be on the voter rolls for two election cycles, so that means probably about four years. Then, if for some reason you haven’t moved but you ended up on the list, the way to take yourself off the list is to just vote in one of the elections.”

Ramsey urged people to take all of these steps now so that they can make sure their vote counts come November.

“The message I have for people is to don’t assume that your status might always be active,” he said. “Double check and check often.”

“Election integrity is essential to our democracy,” Abbott said. “The Secretary of State and county voter registrars have an ongoing legal requirement to review the voter rolls, remove ineligible voters, and refer any potential illegal voting to the Attorney General’s Office and local authorities for investigation and prosecution.”

On Monday, the League of United Latin American Citizens, or LULAC called for the federal Department of Justice to intervene in the state’s investigation into allegations of vote harvesting. The call comes after some LULAC volunteers said the state authorities raided their homes and seized phones and computers.

Attorney General Ken Paxton said the searches are tied to allegations that Frio County officially illegally harvested votes for local races. Those accused deny the allegations and worry the investigation could stifle legal efforts to help elderly voters get registered.

Top Texas Republicans have dedicated significant time and resources to targeting voter fraud, though cases in Texas are exceedingly rare.

The review comes after Abbott signed Senate Bill 1 in 2021, which increased the penalty for lying while registering to vote to a state jail felony and requires the Secretary of State to audit random county election offices every two years.

The focus on penalties has some people worried about the effect on voters.

“It’s concerning because we don’t want to scare people who are eligible to vote to not go to the polls,” LeBombard said. “We are concerned that it might cause some people to not go vote, just based on the way things are being phrased by the Governor and Attorney General.”

Eagle Pass Democrat Eddie Morales called state investigations into voter fraud and ballot harvesting a “scare tactic.”

“This false narrative that there’s all these undocumented folks that are registering to vote, that our election system somehow is rigged… it’s not,” Morales said. “It is anticipated that there will not be any problems in the November election. We have a great checks and balances system in place.”

Lawmakers from both parties stressed the integrity of Texas elections and encouraged Texans to vote with faith that the system is fair, accurate and secure.

“What we want is our voters to say, ‘these are fair, these are transparent, my vote counts.’ As a state, we need to be the gold standard for the country, and the country, the gold standard for the world,” State Rep. Mano DeAyala, R-Houston, said.

The last day to register to vote in the November election is Oct. 7. Check your voter registration at VoteTexas.gov .

Gov. Abbott planning to expand buoy border barriers in Rio Grande

Abbott recently said he plans to expand  buoy barriers  across the Rio Grande to stop migrants from crossing the southern border but is waiting for a court to affirm the state’s right to use them.

In an exclusive interview with NewsNation, Abbott said buoys are one of the most effective ways to discourage  migrants  from trying to cross from Mexico into Texas. He added the cost is “one-tenth” that of a border wall. 

“You can expect to see an increase of the buoys in the Rio Grande River,” Abbott said, but added that he is waiting “on a final decision from the court that has to enforce what the Fifth Circuit already told them to enforce before making that investment.” 

In July, the  entire appeals court  for the 5th U.S. Circuit overturned a previous decision by a divided panel of the court that sided with a federal district judge, who ruled that the buoys must be moved under a preliminary injunction. 

The full bench said the court abused its discretion in granting the injunction.

The broader lawsuit is still underway, where the Biden administration accuses Texas of violating the federal Rivers and Harbor Act. The court will decide the merits of the federal government’s claims. 

Housing affordability is a challenge for Texas, Comptroller’s report finds

A  new study from the Texas Comptroller  shows just how widespread housing affordability challenges are in Texas.

According to the report, Texas is more than 300,000 homes short of what it needs and Texans from major cities to rural communities are struggling with housing costs.

Comptroller Glenn Hegar noted in the report, “Housing supply is the crux of the affordability issue, and there are no easy, clear-cut fixes to this challenge.”

“The fact is, we need to be able to make more housing available, both single family and multi family residences, and what that means, in large part, is dealing with local zoning laws as well as the time that it takes permitting to get these applications in these houses being built,” Hegar told State of Texas host Josh Hinkle.

Some suggestions to encourage more home construction included the state working to reduce property taxes, increasing funding for low- to moderate-income housing programs as well as offering incentives to increase the housing supply at the price range where it’s most needed.

“When people don’t have as much money because they are spending more on housing, they don’t have quite the disposable income, and that impacts their quality of life,” Hegar noted.

“That doesn’t quite get the attention, that maybe road congestion, making sure that we have water quality, public education, higher education, those are all things that are components for a strong economy, but affordable housing is equally important as many of these other topics,” he added.

Hegar also advised local governments that they could do their part by possibly making the permitting process simpler and looking into more public-private partnerships to address housing affordability.

Acting on some of those ideas could come next year when state lawmakers return to the Texas Capitol for a new session on Jan. 14.

“The first thing that I wanted to do is bring a greater awareness that this issue is equally as important, or more important in the long term than several other issues, to the economic affordability of the average Texan in this state,” Hegar said of the report.

“The next steps are finding what are the more targeted solutions that we can help resolve affordability in the long run, and that’s the next step that we’ll work with the legislature on,” Hegar added.

Texas looks to protect artists from artificial intelligence fakes

Josh Abbott is proud of the Texas roots that ring through his red dirt music. His band has risen to statewide stardom since he founded the country group while studying at Texas Tech in 2006. Now, he worries that grit could be grifted by fakes powered by artificial intelligence.

“There’s all sorts of ways AI can be used for good in all industries, but there’s also ways it can take advantage of people,” Josh Abbott told Nexstar after testifying on the issue in front of the Senate Business and Commerce Committee on Tuesday. “My focus right now is to limit how it can take advantage of people like myself, but also all of my friends, colleagues, peers in the music industry.”

Josh Abbott warned legislators there are insufficient restrictions on the name, image, and likeness of artists, especially relating to “deepfakes” of a singer’s voice.

“Somebody could go out, record a song, put my name on it, have an AI-generated version of my voice and perhaps my band, and it misrepresent our band. Or even, maybe it’s really good and it streams a ton, but we’re not seeing any royalties from that,” he said.

Some AI programs can now produce convincing voice impersonations of artists on demand, mimicking their unique sound and even lyrical styles.

The issue capped Tuesday’s hearing where state senators grappled with the benefits, and risks, of the emerging technology.

“We are, in real time, trying to figure out how to govern a thing and regulate a thing that doesn’t even fully exist yet,” State Sen. Nathan Johnson, D-Dallas, told Nexstar. “We’re in a totally new frontier.”

Johnson anticipates lawmakers will file a “buckshot” of bills relating to AI when the next session convenes in January, leading to unconventional political alliances around issues that do not fall neatly into ideological lines. He said the issue is about no less than Texas’ identity.

“When we’re talking about art in particular, that is an economic driver,” he said. “But as one of the witnesses said in the hearing, it’s also our culture. It’s our cultural soul. If we don’t protect artists, we won’t have any art. If we don’t have any art, our whole civilization dies. I don’t want to be melodramatic, but really — it’s what we are.”

In the self-proclaimed “Live Music Capital of the World,” the Texas Capitol is behind other states in protecting artists’ intellectual property. In March, Tennessee Governor Bill Lee signed the “ELVIS” Act into law — “Ensuring Likeness Voice Image Security.” The law builds upon state identity protections to include “voice” in the category of protected likeness.

In August, Illinois Governor J.B. Pritzker signed a law increasing protections for recording artists that will go into effect next year.

Congress is also trying to tackle the issue. In January, Rep. Maria Salazar, R-Florida, introduced the “No Artificial Intelligence Fake Replicas and Unauthorized Duplications Act, or No AI FRAUD Act.” The bill has bipartisan support and says individuals have property rights to their likeness and voice. Cosponsors include representatives like Republican Nathaniel Moran and Democrat Henry Cuellar of Texas. The bill is pending in the House Judiciary Committee.

The White House also developed a blueprint for an AI Bill of Rights in October 2022 that includes guidance on data privacy. It says AI developers should seek permission before using someone’s data.

Texas won’t take any legislative action on the issue until at least mid-2025. Lawmakers return for the 89th legislative session in January.

“Your voice is your brand, your skills are your brand. Your name, your image, your likeness, we have a duty to protect those things,” Josh Abbott said. “Texas culture specifically has such a long history and pride when it comes to Texas singers and songwriters… if you think about it from that perspective, it really puts a high importance and priority on protecting those people.”
